township of pickering the finding of the court is of much local interest to municipalities such as whitchurch and markham wherein are located institutions carrying on philanthro pic work supported wholly or in part by private or public funds which might claim exemption from taxation under the assessment act the action was an appeal from a decision of the court of revision of the township of pickering for the year 1934 which was refused exemption from taxation on prop erty consisting of five acres of land tho third concession of the township on which there are er ected a number of frame buildings including a hall dining room seven cottages three smaller cottages a hospital bath house and showers also located on the pro perty a tennis court volley ball yard small golf course and baseball field three wells and a creek course through the property the assessment for the year 1931 was 2000 on tho land and 4000 on tho buildings these figures be- ig as already noted being affirmed by the court operated by the tribune published every tnurfaay at stouffville ontario yearly subscription rate canada united klnjrdom 200 united states poimt 150 a v nolan the power contracts our mail for the past week has been saturated with appealing circulars from the investment dealers association and many brokerage houses and investment concerns in the money ring all con demning the action of the ontario government in throwing overboard the hydro contracts which were costing the users of electricity millions of dollars each year for current for which not even a trans mission line is built to bring the power from quebec to the users in ontario this paper has no quarrel with premier hepburn in getting rid of such a lopsided agtement the in vestment dealers and all the rest of them cry aloud about sacred con tracts well what about the sacred contract those politicians entered into to serve the people faithfully and honestly did they do it when they contracted to take millions of horse power from quebec for which there is no use whatever even it it did look as though more power would be needed than was available surely anyone with an ounce of senso would have had a saving clause in the agreements so that tho toronto work- this pr0v or theusers of light mans circle colony and childrens woul uo had to pay the full camp according to the evidence one julis t seltzer testified at the price per librse power in the event they could not take the power the hearing of the appeal that the cost o producing the power should workmans circle is interested in least have 1een exercises all af ter public school hours and that this pickering camp is an exten sion of the school in toronto it was also given in evidence that this pro perty is occupied only from the 1st of july to the 5th of september of each year and is used exclusively for the benefit of the children the camp includes sleeping accommoda tion and there are three teachers a physician and a nurse evidence further disclosed that certain revenue for the upkeep of the camp is obtained from certain tees paid by tho members of the workmens circle bazaars teas and private donations statement of the auditor mr jule newman i dated october 10th 1934 filed as evidence showed that in 1934 for childrens fees and other cources of revenue a total of s0s052 and that after paying for food salaries and other expenses and giving credi tor receipts of bazaar donations and pledges there was a deficit of only s599 the court notes that it was not shown in evidence what would have become of tho money if there had been a surplus evidence furter disclosed thai only those financially able amount ing to about 50 per cent of the j children paid anything and that the poor paid nothing to this i extent probably the workings of i the camp would be charitable but the rich and the poor are accom- modated alike at the camp the court says judge ruddy noted that no char ter was produced to show the ob jects and purposes of the society and that there was nothing but the evidence of mr seltzer and mr ribo to show that the camp is a charitable institution conducted on charitable lines the court finds that the convey- iance deed of the property which was produced at the trial shows an entirely different purpose in my view says judge ruddy on the on the inside track of the whole thing we are urged by all these invest ment houses to wire the premier our protest well if any wire goes for ward from the office of this paper it will read thus your on the right track demand justice steckley estate sells a so that the child- relatives attended rcn will not neglect their religious training and faith and their con- stant study of tho jewish language and history the purposes of the camp appear to he very praisewor thy and charitable to a largo extent and may merit exemption from as sessment but unless there is some legislative authority tho property must bo assessed tho court expresses tho view that the township authorities took the objects of the camp into con sideration in leaving tho assess ment so low judge ruddy does not uphold tho argument advanced at the hear ing ot tho appeal that this property might be exempt under subsection 4 of the assessment act as a sem inary of learning but notes that no right to exemption was seriously urged other than the provisions of sub section 9 counsel tor the ap pellant contended that this proper ty comes under the clause other charitable institutions conducted on philanthropic principles and not for the purposo of profit or gain con tained in that subsection i think says judge ruddy in conclusion that this camp is in no sense in tho category of other in- stltutlons referred to in this section btouffville phone 18401 tho appeal is therefore
