crop judges decision witheld further evidence was heard at whitby on thursday in the county court by his honor judge thomp son in the action brought by edgar dure farmer of mara and former ontario county warden against the brechin milling company for al leged damages to his farm loss of crop loss of possible sales of farm products etc amounting in all to two thousand dollars plaintiff claims that he purchased from the defendants through malcolm mcntb their manager of 1930 two bushels of red clover seed represented to be it was alleged of hirst class quality the seed was sown as red clover and later weeds of a strange variety made their appearance in the clover field these being identified later by government experts at tor- onto and ottawa as pepper grass a secondary abnoxious weed which il was alleged grew up so thick that it destroyed the clover crop and caused plaintiff heavy damages at the resumed hearing counsel for the defendant company called numerous witnesses in an effort to prove that mr dure did not pur chase the alleged itefective clover seed from their manager mmcnab or from any other person in the mill on the 29th of april also that the books accounts vouchers etc of the company failed to show any transaction with mr duro on that date mr dure claimed that he paid cash 40 for the seed he purchased but witnesses testified that this could not have been the cose as there were no records to shew the transaction earl dure son of the plaintiff testified that he was with his father when the clover seed was naught from mr mcxab the defendants manager he was in the box con siderable length of time and was subject to a stiff crossexamination by defendants counsel mr harvey of orillia court adjourned until friday when the final evidence was submit ted it was agreed that both coun sel for the plaintiff and defend ants would submit written argu ments to his honor judge thomp son before a decision was given over twenty witnesses were heard in the action including ex perts from the seed branch of the department of agriculture at ot tawa and toronto the case has aroused considerable interest throu ghout the county particularly among farmers as it is somewhat unusual edgar dure the plaintiff was the final witness to take the stand on friday afternoon before the case closed being called by his counsel fred c macdonald of beaverton to give rebuttal evidence in reply to evidence given by witnesses for the defense mr dure emphatically de nied that he had made a statement to any person as alleged that he did not keep a sample of the seed which he bought trim the brechin milling company he also denied that he had said that ho had sewn his own clover seed which he had saved from his alsac under crossexamination by mr harvey of orillia defendants coun sel mr dure admitted that he had i old several persons in his district including the directors of the mill ing company that he did not know it ho had paid for the seed which he alleged he purchased from the mill from malcolm mcxab the companys manager although in his statement of claim for damages he claimed that he had paid cash to mr mcxab for the seed you can lie when it suits your purpose suggested mr harvey pressing for an explanation as to why he had told some people that he did not know whether ho had paid for the seed and then told the court that he had paid cash for it mr dure explained that he had done so to protect mr mcxab as there was a story in circulation to the effect that mr mcxab had got the money he paid him for the seed and had not accounted for it wit ness said that he had every con fidence in mr mcxab and wanted to do something to protect him mr dure resented the suggestion by de fendants counsel that he lied when it suited his purpose stating em phatically that he had given the court evidence to the best of his knowledge and ability and imsm n actual facts mr dure stated further that he had taken his case to the companys directors with the hope ot getting a settlement and avoiding a court action mr dure told the court that his bethesda lad saves child from drowning the prompt action of master alex iogau sou of our storekeeper at bethesda savedthe life of little irene staley from a watery grave over at prestons lake vandorf on saturday afternoon the boy plunged into the 3 feet ot water from where he was fishing off a log and brought the little girl to land the body was quite limy and only a few moments more rescue would have been too late to save the life only children were in the immediate neighbor hood at the time young alex logan journeyed from his home at bethesda bent on having an afternoon fish at the lake ho was sitting on a log while a group of children all very young liayed at the waters edge sudden ly a scream went up and alex saw the plight of the young child she lad gone under when he reached j the body the rescued child irene staley is the granddaughter of george staley who is well known in the township the authorities should recommend alex for a medal to mark his bravery in saving the young life which he has to his credit the lad is only 11 years of age assessment court strikes a snag reeve morden polls deciding vote to sustain assessment on w b sanders residence stopped at the border the drastic action of the emi gration department at niagara last week almost brought havoc to the camp meetings now in progress at pikes bush just north of bethesda mrs alice durham evangelist in charge who is an american citizen found it was difficult to enter this country at the present time even to popular sermon he later delivered at buffalo on the text stopped at the border only two appeals came before the municipal council on monday even ing which sat as a court of revis ion on the assessment roll tor the year 1932 one was withdrawn and mr isaac boadway was then heard he appealed against the assessment of 2700 on his newly acquired property the old w b sanders place opposite the station 600 is placed against the land and 2100 on the brick residence now a double dwelling councillor rusnell moved that the assessment be reduced 200 and councillor watts moved that it be sustained assessor george storey thought the amount set by him was fair but would not oppose the court if they saw fit to reduce the amount a similar sized place is dr storeys residence assessed at 3000 this was held to be a better property but was proportinately higher said members of tho court mr boadway considered that he had been penalized with high taxes because he improved tho place and that only half was rent ed at 15 per month total taxes are 112 a division was encountered when councillors rusnell and dowswell supported tho reduction of 200 and councillors watts and weldon voted nay the reeve had the decid ing vote and sustained the assess ment at tho old figure mr boadway unsuccessfully appealed last year and said he might appeal to the judge he has five days in which to file such an appeal trustee meeting excludes press rumor says salaries of i s teachers reduced at their special meeting in the clerks birthday the genial clerk of whitchurch township mr william crawford is receiving the congratulations of his numerous friends on the attainment of another birthday these events came rather thick in the crawford home last week the following day john crawford son of the township clerk had a birthday while a grand child ross avis also chalked up an other milestone the triple event was the occasion of a family gather ing at the crawford home and friends far and near sent flowers and congratulations mr crawford has made a remarkable recovery from a serious illness and is carry ing on his onerous duties as town ship official with his customary wel coming smile peter b forsythe honorary chieftain of the for- sythe clan peter b forsythe died last week in his seventythird year at the home of a niece in xewark x j he was born in uxbridge in the centre of the district in which tho six hundred and more members of the clan are located mr forsythe was formerly engaged in real estate and financial business in washing ton d c since his retirement ho had spent much time travelling pay ing two or three visits every year to the seat of the clan in ontario he is survived by one sister mrs e d winchester of grand rapids mich and by numerous nephews and nieces his wife predeceased him interment was made in washington d c tried to start a conversation about the seed case before the court but he refused to make any comment whatever muir he alleged then told i waggs on sunday mr and mrs mckendry of tor onto visited friends here on sunday miss mcmuty of toronto visited at dr failings for a few days goodwood box lacrosse players had their first match on saturday night when they beat altona 21 their next game is with stouffville on tuesday night while dr darling and daughter heleno were motoring last friday coming home down the hill just west of goodwood the car began to swing while helene was driving her hair blew down over her face and in attempting to put it back tho car ran into the ditch and went over in the right side breaking the glass in tho door and bending the fenders on account of going slow no one was injured a special session of the school board was held on wednesday even ing of last week but the press was not represented the chairman call ed tho meeting and advised tho members that it would be just as well to treat the notice of meeting subrosa meetings of public bodies held in camera invariably invite suspicion and plenty of whispering was going on so that the press which it was intended to exclude from tho gathering was cognizaut of what was taking place all tho time but we didnt want to spoil the plot and refrained front turning up on the night appointed it is currently rumored on the street that tho salaries of public school teachers were reduced at the special meeting tho street report may not be correct however at the jiay meet ing of the school board these salaries were under discussion and it was agreed to defer any action until the june meeting thus if teachers wished to speak on their own behalf they would have this opportunity to exclude the press where so wide and important matter is dealt with is hardly fair to the ratepayers the press has given the salary question for the public school a fair discussion to show the actural saving che pro posed cut in salaries would mean neither in this or no other way has the local paper embarassed the mem bers of the school board that they should shun publicity all members of tho school board were present at the closed session but all by no means favored the meeting being held under cover so to speak the members are trustees e a lloyd annual de partmental examinations has been announced by the department of education the imiddle and upper school exams commence on mon day june 20th the lower school on thursday june 23rd and the en trance examinations in the local high school will conclude on juno 3 0th as an economy measure the department has decreased the pay for presiding officers as follows h s exams presiding officer 12 to 10 assistant from 9 to 750 entrance exams presiding officer 9 to 750 assistants 7 to 550 per day annual churches of christ meeting ringwood mr and mrs george mctavish and family of gilford spent churches of christ of ontario will be held at pine orchard on satur day and sunday june 11 and 12 meetings on saturday will com mence at 230 and 730 pm on the lords day services will commence at 930 am 230 and 7 pm dinner and supper will be served on the sabbath and all are wel come to attend any or all these meetings the municipal council met on monday evening clearing tho slate in short order reeve morden pre sided all other members being pre sent namely councillors weldon watts rusnell aud dowswell tho athletic commission was granted permission to uso the street on the evening of august 1st for a street carnival mrs ward sent a letter of thanks to tho council for their kindly re membrance to mrs ward and family during their recent bereavoiuont in the death of her husband a former councillor in stouffville on motion ot councillors dows- woll and rusuell tho clerk was in structed to order 1000 gallons of road oil at a cost placed on the road of slightly over 100 for use on the 9th and 10th concessions the ninth south will bo gravelled but not oil ed this year this oil is calculated to preserve the gravel on these main thoroughfares tho reeve pointed out that a tarvia top road suitable for sido streets can be secured now at 40c per square yard which some one said was cheaper in the long run than gravel the reeve did not think it feasible to consider this iype of road just at present some discussion took place ovor laying a now walk in front of new- bank of nova scotia premises now a brick sidewalk councillor rusnell pressed for a new pavement but no action was
