negligence in the part of the hospital after giving him a sleeping draught to leave him olone and unattended by some nurse with a cigarette in his hand i cannot help from the evi dence feeling that what the plaintiff was paying for was nursing anil waliching in this case the sleeping draught no doubt induced insensi bility from sleep for a time and i feel it was the duty of the hospital to see to it that some nurse was there and that some nurse prevent the patient from falling into in sensibility at a time and in such a way as would result in the firing of his bedding and clothes and caus ing him the injury he suffered special nurse his lordship finds that as a re sult of telephonic communication the patient was informed that the hospital would receive him on two conditions one was that he have and pay for a special nurse aud the other was that he employ a doctor who would make the arrangements for entering into the hospital in such a way as would enable the hospital to bo assured that the patient to be refeeived was a patient for whom the doctor was willing to be responsible the special nurse said the judge explains that the patient went to sleep about 1130 and that she then went away to get some lunch the plaintiff claimed that when the nurse left her lunch he was awake and that he knew no more about his condition until he awoke about an hour later with his bed afire the supervisor said that she had gone into the plaintiffs room about 12 oclock and that he was asleep and snoring the special nurse claimed that she had also come in within a tow minutes of the time and that prosser was asleep she said site then went into the hall to write her chart returning in a few minutes to find the bed ablaze there is no doubt the plaintiff was burned seriously the judge holds justice mcbvoy finds that the de- fondants told the patient he must have a special nurse but ho is not able to find that the nurse thereby became subject to the orders of the patient hospital not exonerated the hospital his lordship de clares intended to keep control and supervision and direction of tho special nurse i am not able to exonerate the hospital upon the ground that the hospital had no re sponsibility for the conduct ot the special nurse it is true tho hospital selected tho nurse and it is true the nurse selected was a competent nurse of reasonable skill or ability insofar as the hospital had reason to know and did know his lordship expresses difficulty in understanding how the supervis ing nurse could go to the foot of the bed and not become aware that the bod was afire and equally that the special nurse could come in a fow minutes later and also be una ware that anything untoward had occurred tho two visits at so short a period beforo mo tiro was dis
