and confirmed the statements of hillis so far as setting fire to the store was concerned he could tell of no arrangements with slee as to setting fire to the store but did make a deal with hillis to do the work and did do it and he got 16 for it from hillis witness during cross examination said he had previously served a five year term and was now doing a three 3ear bit for the theft qf bonds from james lucas at port perry he also admitted he had a checkered criminal career slee on the stand denied the truth of the statements made by hillis and laing and said there was no opposi tion to speak of between his store and bartletts and that his business was flourishing and that hehad re fused to sell out a number of witnesses were call ed by the crown and a few by the defence including mrs slee and character witnesses mr lennox in addressing the jury advanced the argument that hillis laing and ward had robbed the bartlett store and then set fire to it to cover up their tracks but offered no sugges tion as to why the men accused slee of conspiring to commit arson mr shearer held in his address that slee was guilty of the offense charged and stressed that hillis a man of skill in his unlawful profes sion was a proper person for anyone who wanted arson done to hire that if burglary had been done and fire then set to the building he held that the men would have taken 23 that was in silver under the till in the store which was not done his lordship charged the jury at some length on the law in the mat ter dealing with conviction on the evidence of accomplices and the method of selecting a truthful wit ness he charged that hillis had no advantage in telling a storv that was not true and it was backed up by laing who he remarked had some spark of good left in him he dis credited slees evidence whicn he said was of tremendous advantage to slee if it was believed and re marked the crown witnesses had no thing to gain they being now in penitentiary serving long sentences is there anything to indicate that this was not a straight piece of wicked malicious arson- he asked the jury he could not see where the evidence showed there had been moving pictures dr w j
