mises but forsyth held that it did not include the hay alleged to have been used by mcnelly isaac meyer was the only witness called for the defense although others were sub poenaed while ralph- connor was the sole witness for mcnelly the evidence was of a contradictory na ture and his honor judge mcgilli- vray gave judgment in favor of mo- nelly on the ground that in the written agrement te word
