1 purpose ami effect of bylaw 1613 i to amend bylaw 1517 the zoning bylaw of the corporation of the township of uxbridge town ship ii to implement the recommendations of the ontario municipal board board contained in its decision dated march 24 1970 dealing with bylaw 1517 hi to plan in part for the develop ment of sand and gravel operations in the township of uxbridge by a more accurately locating sand and gravel operations b separating same from land in tended to be so used and c providing notice to the public of existing and intended land uses iv to repeal bylaws 1589 and 1611 in cluding the key maps attached to each as schedule a passed on the 29th of march 1971 and on the 17th of april 1972 respectively v to implement changes requested by ratepayers in the township 2 lands affected by bylaw 1613 all the lands and landowners in the town ship of uxbridge 3 present zoning bylaw 1517 and pro posed zoning changes bylaw 1613 ti section 232 of bylaw 1517 defined gravel pit to restrictions from the front yard rear yard and side yard limits of property within which distances sand and gravel op erations are prohibited bylaw 1613 extends the setbacks to excavations in addition to buildings v bylaw 1613 creates 3 new zones de scribed as a sand and gravel agricultural zone a3 b aggregate processing zone m5 and c quarry holding zone hm3 this required that the key maps 1 2 and 3 forming part of schedule a attached to bylaw 1517 be re vised and replaced by key maps 1 2 and 3 forming part of schedule a to bylaw 1613 vi the index map forming the other part of schedule a attached to bylaw 1517 has been revised and replaced by bylaw 1613 and it pro vides two legends the first re- categorizes roads and the other pro vides a legend for the key maps which show the roads vii section 52 of bylaw 1517 estab lished the zone boundaries of pits and quarries to coincide with the outlines thereof bylaw 1613 deletes this so that the zone boundaries of pits and quarries are determined according to key maps 1 2 and 3 viii section 68 of bylaw 1517 defined frontage on street to mean pro perty fronting on a township road a county road or a provincial high way bylaw 1613 replaces this with the requirement that the property have direct access to an improved road as designated in schedule a attached thereto ix a new section 622 has been added by bylaw 1613 which prohibits the establishment of pits or quarries ex cept in an authorized zone where land is allowed to be used for the planting of grass shrubs seeded berms trees or similar uses the section prohibits pits or quarries from being established x bylaw 1517 allows as a residential use in the restricted agricultural zone al and the general agricul tural zone a2 a detached single family dwelling house or a home occupation in a permitted dwelling house bylaw 1613 adds a new section 9a which establishes a sand and gravel agricultural zone a3 but only allows as a residential use a detached singlefamily dwelling house if occu pied by a caretaker watchman or other similar person employed full- time on the same property bylaw 1613 only permits as non residential uses in an a3 zone a farm a golf course or driving range a private park a public use or a seasonal fruit vegetable flower or farm product sales outlet it main tains the same zone provisions as established by bylaw 1517 for al and a2 zones xi section 16 of bylaw 1517 establish es rear yard and interior side yard setback restrictions for in dustrial zones these provisions are retained by bylaw 1613 but are not required if the adjoining pro perty is zoned m3 ml m5 or hm3 except as set out in xiv below otherwise bylaw 1613 states no sot- backs are required if the adjoining owners agree to dispense therewith xii section 19lb of bylaw 1517 per mitted as nonresidential uses in an m3 zone an aggregate storage area a concrete batching plant and a crushing plant bylaw 1613 deletes this and allows a portable processing plant and a sand or gravel stock piling operation in an m3 zone xiii section 192 c of bylaw 1517 es tablished a special provision screen planting which stated that no land in an m3 zone could be used for any purpose other than for planting grass trees or similar use within 100 feet of any residential commercial or agricultural zone or within 70 feet of any street line bylaw 1615 replaces the option of planting grass with the option of planting a seeded berm but requires screen planting within 100 feet of any commercial or al or a2 zone unless all owners of land within that distance agree to dispense there with or within 250 feet of a resi dential or village zone unless all owners of land within that distance agree to dispense therewith xiv section 192 d of bylaw loli es tablished a special provision concrete plant which prohibited a concrete batching plant crushing plant or aggregate screening oper ation to be located in an m3 zone within 450 feet of any street or side lot line or within 250 feet of any rear lot line as set out in xii above bylaw 1613 does not allow these operations in an m3 zone but does establish special provisions port able processing plants and sand and gravel stockpiling operations the new bylaw requires a setback distance of 50 feet from any adjoin ing m3 m4 m5 or hm3 zone for sand and gravel stockpiling opera tions in an m3 zone and 450 feet from a residential village or com mercial zone for any portable pro cessing plant or sand and gravel stockpiling operations in an m3 zone unless all owners within the said distances agree to dispense there with xv bylaw 1613 adds a new section 192 e which allows land desig nated on the key maps as m31 to be used for a contractors yard in cluding outside storage a contrac tors yard is defined to mean an area where the owner or operator ser vices maintains andor stores his construction andor his mining equipment xvi bylaw 1613 adds a new section 19b which establishes an aggregate processing zone m5 no residen tial uses are permitted and the allow ed nonresidential uses are for an aggregate storage area an aggregate screening or washing plant a con crete batching plant a crushing plant and a gravel pit previously bylaw 1517 allowed these uses in the m3 zone three special provisions relating to screen planting aggregate process ing plant and asphalt plant are set out by this section the screen planting requirements are identical with those of the m3 zone as set out in xiii above the aggregate pro cessing plant prohibits a concrete batching plant a crushing operation or a screening operation from being located within 50 feet of any lot line abutting an m3 m4 m5 or hm3 zone or within 450 feet of any front or side lot line other than one abut ting an m3 m4 m5 or hm3 zone or within 250 feet of any rear lot line other than one abutting an m3 m4 m5 or hm3 zone unless the adjoin ing owners agree to dispense there with land designated by the key maps as m51 may be used for an asphalt plant xvii bylaw 1613 adds a new section 19c which establishes the quarry hold ing zone hm3 the residential uses permitted are the same as for the a3 zone set out inx above the permitted nonresidential uses are a farm and a public use and the zone provisions are the same as for the a3 zone set out in x above 4 general i bylaw 1613 is to become effective on the 5th of june 1972 subject to receiving the
