two in fact to govern truck traffic on south road musselmans lake from the start mayor ken laushway ruled with a firm hand he contended that both bylaws should be properly aired and admitted that ronald lee of lee sand and gravel company limited had been provided a copy of the conditions in advance mayor laushway reminded the audience that while anyone has a right to address council he must give notice five days prior to the meeting and state his subject those who had not done so said the mayor would not be allowed to speak nor to address questions to mr lee he also warned mr lee that there would be only one chance to present his arguments after mr lee was finished the mayor said and after council members had asked their questions of him the gravelpit owner would be expected to maintain silence mayor laushway indicated that he would tolerate no audience participation while council mem bers discussed the bylaws mr lee thanked the mayor and said he firmly opposed these measures he main tained that the bylaw would not help solve the problems he also asked if the musselmans lake area was considered permanent res idential or tourist resort if it were a resort area said mr lee there would be no need for such a bylaw if its a residential area he said it should not be treated differently from any other street in the municipality councillor gordon ratcliff asked if mr lees objections were based on economic considerations mr lee confirmed this terming it a major financial con sideration the bloomington road he said was not practical because it involves greater distances a high grade for trucks to climb and danger because of the absence of traffic lights at highway 48 he also pointed out that some truckers are residents and tax payers and such a bylaw would not be fair to them councillor june button asked mr lee if trucks would still use the road if the speed limit were 25 miles an hour mr lee said they would councillor herb simpson said his major concern was safety he agreed with mr lee that both trucks and cars are dangerous on this road councillor merlyn baker disagreed with mr lees suggestion that the road be im proved that would mean cutting down large numbers of trees to widen the road he said i dont agree with that mr lee defended his position vigorously how wide is a truck he asked about eight feet said councillor baker then how wide is a house trailer demanded lee councillor baker conceded that it would be about the same why is one more dangerous than the other mr lee asked councillor baker conceded that truck drivers might on the average be good drivers but he maintained that the trucks present an unacceptable danger mr lee replied that his truckers had had no accidents in the area mayor laushway interrupted the ex change and asked mr lee if he had anything more to say in sum mary mr lee concluded by saying he felt the matter needed more study and asked that council take no action before ensuring that fair representations had been made by all affected parties mayor laushway then left the chair and stated his own views i feel this is a resort area he said it is not suitable for trucks during the holiday season he also expressed disappointment that no compromise could be maintained of the sort that kept the trucks off that road for about a week and a half he indicated that he would not support the banning bylaw the bylaw in troduced later con tained five main clauses the first defined heavy traffic as any vehicle of more than five tons gross weight clause two forbids such vehicles to use the roads in question but the next clause makes an exception i for delivery trucks emergency vehicles or a truck belonging to a resident going to or from his job clause four provides a fine of s10 maximum for the first offense and 50 for subsequent of fenses the final clause provides that the bylaw shall come into effect only upon ap proval by the minister of transport and communications during clause-by- clause discussion mayor laushway expanded on his earlier statements i feel its the wrong time to pass the bylaw he said although he felt it would come sooner or later he pointed out that this would also apply to municipal vehicles and would force them to make a detour the mayor also wondered about enforcement of the measure i havent changed my mind on this issue he said i have to object to each clause i was alone before and ill be alone again councillor gordon ratcliff was equally firm in his support of the bylaw if we dont start now we never will he said this is a nice lake and it has to be protected council was split on the issue councillors ratcliff button simpson and baker supported the bylaw while mayor laush way and councillor tom lonergan op posed it a winners of
