varley staff writer a judge who was to decide whether or not the newmarket courthouse is a health risk has removed him self from the case because of a health problem mr justice vibert lampkin said tuesday he has developed an ear infection this puts justice lampkin in a conflict of interest he said because some evidence in the motion for a change of venue includes more than 300 healthrelated com plaints from people who work in the courthouse which serves all of york region including cases of ear infection i cant say its attributable to the building i cant say it isnt he said but i cant go on with the hearing i could have kept my mouth shut and no one would know but i couldnt live with myself just a week ago an ear infection caused mr justice barry macdougall to drop out of a murder trial defence lawyer morris manning is requesting a pre liminary hearing in an income tax evasion case be moved from the courthouse mr manning represents riccardo digiuseppe the former owner of the major mack hotel in richmond hill who faces three charges of income tax evasion three charges under the excise tax act and one charge of fraud justice lampkin said if he continued with the case he could be seen as being in a conflict no matter what decision he rendered if he ruled in favour of changing the venue the crown could argue he had been influenced by his ear infection if he refused a change of venue the defence could argue he had leaned too far the other way i cant win he said i cant in fairness give a judg ment on the application although the crown sug gested another judge could be assigned to continue the case mr manning argued if justice lampkin steps down the hearing has to begin all over he said if another judge comes in hell file another application to have the hear ing movedto another venue the judiciary and the people who support the judi ciary are getting sick mr manning said the lawyers will be back in court nov 21 to find out what happens next we dont know where
