1985 we didnt stall builder mayor by don atanasoff news editor markham mayor carole bell has angrily denounced statements in the toronto dai ly papers that the town of markham had anything to with builder morris rosens refusal to build 21 homes in markham we did everything expedi tiously and above board said mrs bell in a recent in terview we the town of markham do not have the au thority to force him to build the houses mrs bell was reacting to recent articles in the toronto newspapers that carried coverage of ministry of com mercial and consumer rela tions investigation into the conduct of mr rosen a tribunal was told that mr rosen accepted more than 200000 in down payments from 21 buyers in the mint leaf area of northeast mar kham and never built the homes he also never re turned the down payments to the buyers the buyers even tually had their money re funded from the new home warranty program just be fore christmas of 1983 the tribunal found mr rosen harsh and predatory and found his activities dis honest and lacking in integri ty the tribunal ruled that the licence of morris rosen of marmion building corpora tion and trim construction ltd be revoked permanently in ontario the ruling also ap plies to any company either owned or partly lowned by mr rosen j during toe hearihgjytrv rosen offered a number of ex planations as to why he never went ahead with the project mr rosen who postponed closing dates several times blamed a carpenters strike problems with a subdivider and the town of markham in issuing building permits as reasons for the delays it was markham council in november of 1983 trying to have the town force mr rosen into building the homes however mrs bell noted the town didnt and will never have the authority to force a developer to build we cant force him to pour the cement and dig the holes anymore than we can force him to pay the 3800 said the mayor we just dont have that authority i feel badly if some people think we held them up but we didnt she said while obviously pleased with the tribunals decision on mr rosen mrs bell said there was no guarantee it couldnt happen again i dont believe there is a move to stop builders who have proved disreputable in the past said the mayor just because something went wrong in one place is no guarantee itll happen again we are not in a position to re fuse them rtibut ineyery profession
