limited has entered guilty pleas to 42 counts under the environmental protections act the case was heard in newmarket provincial court last week with judgement reserved following several hours of submissions by lawyers for both the province and the defense the charges involved 11 for dumping excessive tonnage of garbage at the whitchurch- stouffville site during march and april of this year and 31 of making false declarations on tonnage weights mrs lc mccaffrey solicitor for the province told the court the firm had a record of twelve previous convictions under the act and had been fined 14400 in 1977 for overdumping at the same location originally she said ap proval was given for deposits of 150 tons per day however by the spring of 74 between 700 and 800 tons were being dumped there an order required the company to cut back to 300 tons daily mrs mccaffrey said the firm had failed to heed previous convictions its not a matter of a truck load or so she told the court adding the only way we can deter this sort of thing is to take away the gain the fine imposed last time she said didnt work she suggested that doubling the penalty might help there is no other way she said
