ministrys record of protecting the people of ontario rrom pollution is pretty well worthless that is unless a carte blanche guarantee is given to replace any polluted water supply a guarantee that specifies the pollution must be from the york site would be meaningless how would one go about conclusively proving the pollution was caused by the company and not by some other industrial or even agricultural contamination throughout the long and pointless environmental hearing many cases of well contamination were cited and in every case the landfill companys experts maintained the contaminants were from some other source oil in the well casings for example in each case these arguments were supported bythe ministry and accepted by the environmental hearing board v even with a guarantee the onus to prove that the pollution was from the dump would still likely fall on the town or property owner unless the guarantee specifically states otherwise in ontario it is not against provincial law to spread waste under someone elses property and this has traditionally been a civil law matter the ministry may guarantee a water supply but if the onus of proving the source of the
