in on tario county court whitby on wednesday when he told the court that he had held the goods in question as security on loans totalling s70 funnell appeared before judge john e pritchard charged with having in his pos session two typewriters one voice writer and one tape recor der malcolm barnett manager of the oshawa business college told the court that two type writers one voice writer and a tape recorder had been stolen from his office in august he identified four machines in court as being the four missing machines he estimated their total value as used equipment at 1075 brought to station detectivesgt john powell of the oshawa police department told the court he had visited ho tel genosha on sept 6 regard ing the missing machines and had been unable to see the ac cused on monday sept 8 he said funnell accompanied by his lawyer appeared at the osh awa police station with the two typewriters and recorders the accused on advice of his counsel had made no statement at that time other than to say that he had been unaware the articles were stolen this concluded the crowns case as presented by acting crown attorney gilbert mur doch at this point defence counsel george boychyn moved for a dismissal on the grounds that the crown had failed to prove that the accused had ever had the machines in his posses sions his honor did not allow the motion asked for loan in his own defence funnell stated that in august of last year one george peters a for mer bell boy in the hotel had approached him asking to bor row money he had refused him on that occasion he said but a few days later peters reappear ed stating that he had articles belonging to his wife which he would like to sell funnell told the court that peters told him his wife was expecting a baby he said that he had been told that she had done secretarial work at home and had the machines there the machines were all placed in the trunk of funnells car he said and peters was given 40 on a later occasion he said peters approached him while he was standing in front of the hotel this time with the second typewriter under his arm he said that he questioned him about the source of this ma chine and was told that it too had belonged to his wife this machine too was placed in the trunk of the funnel car along with the other three machines and peters was given 10 eventually funnell told the court he made an additional loan of s20 to peters in dismissing the charge his honor said that he found that funnells explanation might re sonably be true and the evi dence failed to satisfy hlra be yond a reasonable doubt that funnell was aware that the ma chines were stolen he told the accused that the crown and police had been per fectly justified in bringing the case to court and warned him to be very careful
