pritch- ard the defendant leonard travis oshawa did not appear in court durston told the court that he had leased a 100acre farm on lot 16 concession 2 scott town ship to travis for a period of three years the terms of the lease stated that travis pay 300 per annum payable semi annually the lease was signed april 1st 1947 and was due to expire april 1st 1951 there after durston said that the tenant refused to pay him the amount owing to him also in the agree ment as in most farm leasings the tenant was supposed to pay the taxes on the property which was done durston stated that the actual rent for the four and onehalf years which travis stayed on his property amounted to s1350 total rent of which s500 was actually paid leaving a bal ance of s850 due rent therefore there was 1000 owing for rent and taxes in december 1952 travis was evicted from the property and upon inspection it was found that the buildings were left ram- shackled about a foot of manure on the stable floors tractor disl appeared doors broken down shed by the house disappeared windows broken plaster broken off walls in the house and the whole house was left in a filthy condition which durston describ- 1 ed as you just couldnt live in it farm depreciated durston said he put the farm up for sale in 1s53 which sold for 3500 which he had origin ally bought for 4000 12 years before everything was in good re- pair when this nan went there said durston but since then the farm depreciated s300 certain items were seized by durston as part payment such as turkeys wagon and hay which all amounted to 24016 and six payments which travis made making a total credit en titled to travis of 360 against rent damage and taxes judge pritchard said he ac- cepted the evidence of the plain- tiff and believed that the tenant damaged the property by remov- ing and destroying property and left premises in filthy condition he admitted that it was dim- cult to ascertain how much money it would take to restore the property to its original val- ue judge pritchard also found that the defendant agreed to pay the plaintiff these respec tive amounts therefore the balance owing to the plaintiff was stated as si 13292 by judge pritchard soi licitor for the plaintiff duncan phillips said i think your honor the balance owing should read 113293 instead of 1132- 92 judge pritchard replied all right i wont argue city
