dry spell does not end by the mid die of next week However Roger Tomlinson water su perintendent with the Barrie Public Utilities Commission said the citys ninewell system can stand current levels of use provided we dont have any equipment breakdowns and there is no need to ask residents to cut back on water use Lawnwatering and other activities have pushed the pumping rate in Barrie during peak evening hours to the equivalent of 12 to 13 million gallons daya record rate and roughly equal to the systems capacity On daily basis pumping has reached high of 84 to 85 million gallons well above the million usual at this time of year but short of record of 87 million gallons July 17 1975 Equipment failure is not common and the last major case was two years ago Tomlin son said but its an Staff Reporter SANDY COVE ACRES Rent review of ficer Bob Bentley ruled Wednesday he has jurisdiction in complicated case involving £37 tenants at Sandy Cove Acres mobile home park here The decision first of its kind in the history of the provincial rent review program opens the way for rent review hearing July 12 at pm at Eastview Secondary School cafe torium in Barrie At issue will be proposed lot rent increase of $1170 per month which represents to 13 per cent increase over last years rates depending on each tenants base rate An overflow crowd filled the Hub Wednes day at the mommoth mobile home develop ment to hear Basil Stevenson lawyer for San dy Cove Acres Ltd try to convince Bentley he lacked jurisdiction over the case An estimated 150 more residents went away when they could not find room while others stood on the porch outdoors or sat on second floor stairwell railing overlooking the main hall Bentley ruled that rent review legislation amendments passed at Queens Park April 28 give him the right to review rent increases charged by the landlord under escalation clauses contained in lot leases signed prior to July 29 1975 even though the increases are effective Jan and notice was given to tenants March Under the original legislation rents charg ed under the terms of leases dating from before July 29 1975 were not subject to review but the April amendments removed the limitation Stevenson argued that Bentley should ap ply the unamended law which was in ex istence when the increases took effect and notice of the increases was given Bentley however ruled that clause mak ing the amended legislation effective as if passed July 29 1975 gave him the power to treat the amendments as applying to the pro posed increases He noted that the tenants applications for review were filed after the amendments were passed but within the prescribed today period following notice of the increases Bentley said last week the case is the first involving the issue of recapturing escala tion clauses to be heard in the province He said the landlord may go to court for judical review of his ruling or of the power of the provincial legislature to recapture such clauses by law Stevenson had no comment on the subject of an appeal Bentley said he would go ahead with the July 12 hearing even if an appeal is filed unless court orders him to cancel it The Eastview cafetorium was chosen because it provides room for an expected croWd of 400 to 500 and because it is air conditioned Bentley said he expects the hear ing to last about three hours and the decision to
