SECTION DEFINITIONS 31 GENERAL For the purpose of this bylaw the definitions and in terpretations given in this section shall govern In this bylaw the word shell is mandatory and not direc tory words in the singular include the plural words in the plural include the single number words used in the present tense include the future 32ACCESSORY BUILDING shall mean any building or structure which is separate from or attached to the main building in the lot on which both are located and the use of which is an accessory use to that of the said main building or lot and shall include swimming pools private greenhouses patio shelters and carports fences over metres in height and retaining walls higher than metre above ground level in residential zones 33 ACCESSORY USE shall mean use of building andor lot used for the parking of motor vehicles for gain or profit and may include facilities for the servicing cleaning polishing and greasing of motor vehicles and the sale of automotive accessories and related products but shall not include any other defined automotive use 310 AUTOMOTIVE REPAIR ESTABLISHMENT shall mean building and lot used for the servicing repair cleaning polishing and greasing of vehicles and may include vehicular body repair preventative maintenance and repainting but shall not include any other defined automotive use 311 AUTOMOTIVE SALES ESTABLISHMENT NEW shall mean building and lot used for the display and sole of new and used motor vehicles and may include the servicing repair cleaning polishing greasing body repair and repainting of motor vehicles the sale of automotive accessories and related products and the leasing or renting of motor vehicles but shall not include any other defined automotive use 312 AUTOMOTIVE SALES ESTABLISHMENT USED shall mean building andor lot used for the display and sole of used motor vehicles and may include the sale repair leasing or renting of utility or boat trailers and the servicing repair cleaning polishing and greasing of motor vehicles and the sale of automotive accessories and related products but shall not include any other defined automotive use 313 AUTOMOTIVE SERVICE STATION shall mean products and the sole repair leasing or renting of utility or boat trailers but shall not include any other defined automotive use 314 AUTOMOTIVE WASHING ESTABLISHMENT shall mean building and lot used for the washing or cleaning of motor vehicles by automobile washing equipment with capacity greater than five cars per hour and may Include the sole of fuels to motor vehicles but shall not include OR LODGING HOUSE shall mean dwelling in which the proprietor or his agent resides and in which lodging for more than two persons other than members of his family with or without meals is supplied for gain but shall not include motel hotel hospital children home nursing home home for the aged or other similar establishment 319 BOAT HOUSE shall mean building or structure used for the storage of not more than three boats and equipment accessory thereto but shall not include habitable living space or the commercial storage of boots or the sale of fuel or marine products 320 BODYRUB includes the kneading manipulating rubbing massaging touching or stimulating by any means of persons body or part thereof but does not include medical or therapeutic treatment given by person otherwise duly qualified licensed or registered so to do under the laws of the Province of Ontario 321 BODYRUB PARLOIIR includes any premises or part thereof where bodyrub is performed offered or solicited in pursuance of trade calling business or occupation but does not include any premises or part thereof where the bodyrubs performed are for the purpose of medical or therapeutic treatment and are performed or of fered by persons otherwise duly qualified licensed or registered so to do under the laws of the Province of Ontario 322 BUILDING shall mean any structure whether temporary or permanent used or built for the shelter accommodation or enclosure of persons animals or chattels other than lawful boundary walls or fences metres in height or less or retaining walls metre in height or less 323 BUILDING BYlAVl shall mean bylaw as may from time to time be amended which has been enacted by the City of Barrie pursuant to Section 31 of The Planning Act RSO 1960 296 314 BUILDING HEIGHT shall mean the vertical distance from the finished grade level to in the case of flat roof the highest point of the roof surface in the case of monsard roof the roof deckline or in the case of any other roof the mean height between the eaves and the ridge but exclusive of roof or penthouse structure accommodating an elevator staircase tank ventilation fan or other similar equipment smoke stock or other ornamental or utilitarian structure which rises above the roof level but which does not provide habitable living space 325 BUILDING MAIN shall mean the building in which is carried on the principal purpose for which the lot is used 326 CARPORT shall mean covered structure either attached to or detached from the wall of the main building and used for the storage of passenger motor vehicles wherein neither servicing for profit is conducted nor storage of commercial vehicles in excess of tonnes gross weight is permitted 327 CARPORT ATTACHED shall mean carport that shares common wall above grade with the main building 328 CELLAR shall mean that portion of building between two floor levels which has more than fifty per cent of its height from finished floor to finished ceiling used in con nection and forming part of the practices but shall not include accommodation for inpatient core or operating rooms for major surgery 331 COIN LAUNDRY shall mean building or part thereof which houses selfservice laundry containing automatic clothes washers and automatic clothes dryers which are activated for fixed period of time by the deposit of coin in the meter appurtenant 332 CONVENIENCE RETAIL STORE shall mean retail store which offers for sale more restricted range of goods wares merchandise substances articles or things than retail store known as supermarket and which may remain open during longer hours and is located either singly or in small nucleus of commercial functions compatible with residential neighbourhoods It shall include uses such as variety stores jug milk stores delicatessens drug stores and stores which sell groceries meat dairy products bake goods andor tobacco 333 CONVERTED DWELLING shall mean onefamily dwelling which has been altered or converted so as to provide therein two or more dwelling units none of which shall be located in the cellar of the dwelling 334 CUSTOM WORKSHOP shall mean building or part of building used by trade craft or guild for the manufacture nd sale in small quantities of custom made articles 335 DAY NURSERY shall mean place that receives primarily for the purpose of temporary care and custody for continuous period not ex ceeding twentyfour hours more than five children not of common parentage who are under eighteen years of age in the case of day nursery for retarded children and ii under ten years in all other cases and that is not iii port of public school under The Public School Act iv part of separate school under The Separate Schools Act part of private school registered under The Department of Education Act via childrens mental health centre under The Childrens Mental Health Centre Act vii school for trainable retarded children under The Secondary Schools and Boards of Education Act or viii place that is used for program of recreation and that is supervised by municipal recreation director who holds certificate issued pursuant to section 6b of The Ministry of Community and Social Services Act 336 DWELLING shall mean any building or part thereof used as the home residence or sleeping place of one or more persons either continuously permanently temporarily or transiently Dwelling Unit shall mean separate set of living quarters designed for or used by an individual or one family alone which shall include at least one room one kitchen and at least one bathroom and which has private entrance from outside or from common hallway or stairway inside Dwelling Unit Floor Area shall mean the total floor area contained within the outside face of the exterior walls of dwelling unit excluding any private garage open porch verandoh balcony unfinished attic un finished bosement and finished or unfinished cellar Dwelling OneFamily Detached shall mean separate residential building containing only one dwelling unit Dwelling MultipleFamily shall mean residential building including converted dwelling containing two or more dwelling units but shall not include an apartment dwelling Dwelling Apartment shall mean residential building four or more storeys in height containing six or more dwelling units each of which shall have access from on internal corridor system 337 ERECT shall mean the erection building enlargement construction or reconstruction of any building or structure and shall include removal and relocation 333 EMILY shall mean one or more persons who are interrelated by bonds of consanguinity marriage or legal adoption or not more than five unrelated persons with or without one or more fulltime domestic servants occupying dwelling unit 339 PIISHED DRADE lEVll shall mean the average elevation of the finished surface of the ground abutting the external walls of the building or structure exclusive of any embankment In lieu of steps 340 EIST FLOOR shall mean the floor of building approximately at or the first above the finished grade level 341 GARAGE PRIVATE shall mean an accessory building other than carport either attached or detached from the main building or structure not ever one storey in height used for the storage or passenger motor vehicles wherein neither servicing for profit is conducted nor storage of commercial vehicles In excess of tonnes gross weight is permitted 342 GARAGE PRIVATE ATTACHED shall mean private garage that shares common wall above grade with the main building 343 GOLF COURSE shall mean public or private area designed landscaped and used for at least nine holes of golf but shall not include miniature courses golf driving tees or ranges or similar com mercial uses 344 GROSS FLOOR AREA shall mean the total area of all floors in building excepting cellar in residential building measured from the outside face of the exterior walls but exclusive of any part of building which is used for the storage or parking of motor vehicles other than for the Automotive purposes defined in Sections 39 to 315 in this bylaw for locker storage stairwells or for ochanicol or electrical equipment providing services for the entire building In addition to these exceptions in calculating the gross floor area for dwelling apartment the part of the gross corridor areas which are in excess of the minimum corridor areas required under the provisions of the Ontario Building Code and the area occupied by recreational amenity shall not be in cluded 345 GROUP HOUSING PROJECT shall mean group of dwelling units located in two or more buildings erected upon the same lot and either retained under one ownership or registered in compliance with the provisions of The Condominium Act 1967 346 HABIT ABLE LIVING SPACE shall mean any floor space used or intended to be used for living sleeping cooking or eating purposes 347 HEREIN shall mean In this bylaw and shall not be limited to any particular section of this bylaw 340 HOME OCCUPATION shall mean an occupation trade business profession or craft carried on as an accessory use to the use of the dwelling as the private residence of the person carrying on the occupation trade businss profession or craft 349 HOSPITAL shall mean Public or Private Institution as defined under The Public Hospitals Act RSO 1960 322 or under The Private Hospital Act RSO I960C 305 350 HOTEL shall mean building or part of building in which minimum of six rooms is provided for rent as places of abode usually on temporary or transient basis and said building 0r part thereof may include meeting rooms banquet halls public dining rooms and any premises licensed under the Liquor License Act RSO I960 218 but shall not include motels boarding or lodging houses and apartment houses 351 LANDSCAPED OPEN SPACE shall mean open space comprised of lawn and ornamental shrubs flowers and trees and may include paths walks courts and patios but shall not include parking areas driveways or ramps 352 LANE shall mean public or private access not more than metres in width which affords only secondary means of access to property abutting the lane 353 LAUNDRY shall mean building in which the business of laundry is conducted by means of one or more washers and drying ironing finishing and incidental equipment 354 LAUNDRY AND DRY CLEANING DEPOT shall mean building or part thereof used for the purpose of receiving articles or goods of fabric to be subjected to the process of dry cleaning drydyeing or cleaning elsewhere and for the pressing and distribution of any such articles or goods which have been subjected to any such process 355 LAUNDRY AND DRY CLEANING PLANT shall mean building or part of building used for the purpose of receiving the Hydro Electric Power Commission of Ontario and any Department of the Government of Ontario or Canada 376 RECREATIONAL AMENITIES shall include such facilities as common television rooms common card rooms common assembly rooms billiard rooms table tennis rooms racket ball courts swimming pools health clubw sauna rooms and sundecks 377 RECREATIONAL ESTABLISHMENT shall mean uses such as theatre bowling alley curling rink dance hall swimming pool billiard parlour health club athletic club or skating rink 373 RELIGIOUS INSTITUTION shall mean buildings designed adopted or used for dwellings by religious orders and may include private chapel mother house or other similar uses incidental thereto 379 REST HOME shall mean any building in which persons are harboured received or lodged and where in addition to sleeping ac commodation and meals nursing medical or similar care and treatment may be provided but shall not include hospital 300 RESTAURANT shall mean building or part of building the repair or servicing of goods commodities articles or materials but not the manufacturing of same 336 SIGN shall mean an advertisement by means of painting on or at taching bills letters lights or numerals to any structure canopy surface or device and shall include the structure canopy surface or device upon which the advertisement is painted placed or attached 337 STOREY shall mean that portion of building other than cellar or attic sterey which is included between one floor level and the next higher floor level or the ceiling and which is not less than 23 metres nor more than metres in height 333 STOREY HALE shall mean that portion of building situated within the roof or having its floor level not lower than 12 metres below the line where the roof and interior enclosing walls meet and having roof not steeper than fortyfive degrees above the horizontal 339 STREET shall mean public highway which affords principal means of access to abutting lots 390 STREET TOWNHOUSE DEVELOPMENTS shall mean row of not less than five nor more than eight dwelling units attached above or below grade all of which front on street to which Section 427 of The Municipal Act RSO 1970 Chapter 284 applies 39T STRUCTURE shall mean anything that is erected built or constructed of ports joined together or requiring foundation to hold it erect 392 TAVERN shall mean building or structure or part thereof which is solely used for the sole and service of alcoholic beverages with or without entertainment and shall not include restaurant 393 TEMPORARY BUILDING shall mean building or structure intended for removal or demolition within prescribed time as set out in building application 394 THEATRE shall mean place of public assembly intended for the production and viewing of the performing arts or the screening and viewing of motion pictures and consisting of an auditorium with permanently fixed seats solely for viewing audience 395 TRAILER CAMP shall mean lot parcel or area of ground used for occupancy by campers or for occupancy by or of trailers tents or movable or temporary dwellings rooms or sleeping quarters of any kind 396 TRUCK TERMINAL shall mean building andor lot used for the parking andor storage of trucks used for the purpose of delivering or tron sporting goods and materials and may include provision for repair and servicing of these trucks along with associated od ministrative offices and warehousing This building andor lot shall constitute any point on designated delivery or tran sportation route 397 USED shall elso mean arranged designed or intended by the owner or occupant to be used use shall have corresponding meaning 393 UTILITY shall mean Public Utility as defined by The Public Utilities Cororotion Act RSO 1960 336 and amendments thereto 399 VEHICULAR LEASING OUTLETS shall mean building and lot used for the leasing servicing repair cleaning polishing and greasing of motor vehicles for hire and without limiting the generality of the foregoing in cluding automobiles trucks boats utility trailers and recreational vehicles 3100 WAREHOUSE shall mean building used for the storage of goods or materials and shall include wholesale establishments 3101 WHOLESALE ESTABLISHMENT shall mean building used for the storage and sale of quantities of goods and materials for resale or business use 3102 YARD ERONT shall mean open space extending across the full width of the lot between the front lot line and the nearest main front wall of any main building or structure on the lot 3103 YARD REAR shall mean open space extending across the full width of the lot between the rear lot line and the nearest main rear wall of the main building or structure on the lot 3104 YARD SIDE shall mean open space extending from the front yard to the rear yard between the side lot line and the nearest main side wall of any building or structure on the lot THIS BYLAW shall come into force and have effect im mediately upon the final
