eA the examiner Frlday May 1a 1919 Justice travesty THE STORY SO FAR The body of University of Ottawa student Raoul Delorme was £01922 in field in Montreal He had been shot in the head six times with 25 calibre revolver Raoul was the half brother of Rev Delorme 37 year old Roman Catholic priest who was sole executor of their fathers will Under the terms of the will Raoul had received the largest portion of his fathers estate amounting to some $160000 At coroners inquest Father Delorme gave un satisfactory responses to several questions He also turned over his own revolver to the police It was 25 calibre revolver the same as the murder weapon Father Delorme was arrested and charged with the murder of his brother THE LAST OF TWO PARTS Only one other case in Canadas criminal history has held the publics interest to the same extent as the Delorme case That occurred in Hamilton Ont in March 1946 when por tions of John Dicks body were found on Hamilton Mountain In the ensuing years the trials and tribulations of his attrac tive wife Evelyn moved politics and international news off the front page of Canadas newspapers The thought of Roman Catholic priest standing trial for murder was so against the grain of the average Quebecker in 1922 that many thought it was all an English plot to under mine the church Hard to believe Those who remember the murder recall the unbelievable aspects of the case The fact that the victim was bound and had been shot six times almost precluded the possibility that priest could have been the perpetrator of such horren dous act Rumours of every kind spread throughout Mon treal Everyone had pet theory Newspaper circulations soared as the news spread through the province of Quebec and across the land Word of priest being tried for murder was reported in the press of Europe and even Asia Father Delormes legal counsel pleaded that his client was insane and therefore unfit to stand trial For while it ap peared that this tactic would be successful for on June 30 special jury did find Father Delorme insane He was com mitted to the Beuport Asylum Almost year later in May 1923 Father Delorme was released from the asylum on the grounds that he was now sane The month following his release he was committed to trial for the murder of his brother The trial began on June 20 192 tremendous amount of circumstantial evidence was presented in an effort to prove the priest guilty of murder Motive was established when Monsignor Rheaume of Ot tawa took the witness stand He told of day in February 1921 when Raoul was to undergo minor operation in Ot tawa On that occasion Father Delorme and Raoul compos ed Raouls will in longhand in the hospital The Monsignor had signed it as witness Under the terms of the will Father Delorme was to receive the bulk of Raouls estate upon his death To add fuel to the fire it was established that only seven days before the murder $25000 insurance policy had been issued on Raouls life Father Delorme was the sole beneficiary and had paid the first premium Damning evidence Because there were no bullet holes in the victims over coat it had been theorized that Raoul had been shot indoors Dr Derome who performed the autopsy lent credence to this theory when he testified that the piece of quilt wrapped around the dead mans head corresponded to quilting found in Father Dclormes home Dr Derome who achieved star status during the trial also testified that he had found bloodstains in the priests car Father Delorme claimed these stains were the result of the scratches to his knuckles received when he had changed flat tire gunsmith Cesar Haynes testified that he had sold Father Delorme 25 calibre revolver only ten days before the murder Upon comparing bullet extracted from Raouls head with one fired from the priests gun the gunsmith was willing to state that both bullets had most pro bably come from the same gun Raouls rubbers and overshoes were found at home The had been killed in the cellar of Father Delormes home They claimed it was quite possible that Father Delorme had planned to kill his brother with one shot at close range Upon testing it was discovered that his revolver was constructed in such way that the sight was off by one and three quarter inches The initial bullet had travelled through the side of Raouls face rather than directly into his temple They further claimed that once Father Delorme wounded his brother he had no choice but to keep on shooting Every minute of the night of the murder came under close scrutiny The house at 190 St Hubert was home to Father Delorme his three sisters Lily Rosa and Florence and of course Raoul home from Ottawa on vacation Raouls last lunch All the occupants gave evidence that Raoul left the house after lunch stating that he might not be back for supper Li ly and Florence had supper with Father Delorme All three sisters left the house to attend the theatre about oclock that evening and didnt return until 1120 pm At oclock Father Delorme went outdoors where he was observed by several witnesses He returned at 930 If Raoul was killed at home Father Delorme was the only one there and could have committed the crime between 930 and 1120 when his sister returned Neighbors swore they heard Father Delormes car at about 11 oclock that night in the lane beside his garage They heard the garage door open and close but were unable to state whether he was coming in or going out The victims pocket watch had been torn from his body piece of watch chain was found hanging from his pocket Strangely the watch itself was anonymously sent by mail to Chief of Provincial Detectives Lorraine The writing on the parcel containing the watch was carefully examined Ex perts compared the handwriting on the parcel to that of Father Delorme Three experts swore the writing matched that of Father Delorme while fourth refused to swear to it The Crown claimed that the priest had sent the watch as an erratic method of getting rid of it The defense countered with the claim that someone had probably stumbled across the body and had stolen the watch Later guilty conscience may have forced him or her to mail the watch to the police Father Delorme stated simply that all the evidence against him was circumstantial No one saw him kill his brother He was in his cellar from about 10 oclock that night until in the morning repairing furnace until one of his sisters called out to him to come to bed Jury was deadlocked The jury retired to reach verdict On July 21 they reported that they were hopelessly deadlocked Sent back to continue their deliberations they reported two days later that they stood at 10 for conviction and two for acquittal They were dismissed The jury made up of French and English citizens were criticized for not bringing in guilty verdict It was believed that no one of the Catholic faith would find priest guilty of murder We must remember that guilty verdict was tanta mount to death on the gallows in 1923 In February 1924 Delormes second trial for murder again resulted in deadlocked jury It all had to be done third time Father Delormes third and last murder trial began on Oct 1924 almost three years after his brothers body was found with six bullets in the head On Oct 31 the jury retired to reach decision Thousands stood outside the old cour thouse awaiting the result of their deliberations Three hours and fortyfive minutes later they returned with their verdict Not Guilty Father Delorme made brief statement knew would be freed he stated because am innocent hold no grudge against any person vhoworked against me in the case forgive all With the magnaninmuststatement he walked out of the courtroom free man alive spending over two years and nine months in jail The
