court judge said Monday in dismiss ing Crown appeal of the mans sentence Garnet Fredrick Webster 60 of the Lindsay area pleaded guilty to charge of cruelty to an animal and was given two years probation Oct 24 in pro vincial court The Crown launched an ap peal saying the offence should carry either fine or jail term But Judge Lloyd Woods in trnssing out the appeal nmhed that Webster had suffered mne heart attack and the distress of jail term could bring on another The judge said that on the face of it the offence would re quire more severe sentence but the court must consider the accused in this case pre sentence report commented favorably on Websters character Court was told Webster had not intended to be cruel The pony was frisky and the defen dant only took the action for
