Landmgijk decision nin nt Women named persons 50 years 090 OTTAWA tIi Fifty years ago today women in Canada were declared for the first time in law to be persons The news came as complete shock to many women who had not known they were not persons un til they heard it stated that they were Nellie Mc Clung said at the time Mrs Meflung Prairie writer political activist and militant suffragette was one of five Alberta women whose persistent painstaking battle led to the land mark legal decision by the judicial committee of the Privy Council in London England To women celebrating the 50th anniversary of that Oct 18 1929 ruling it has become known popularly as The lersons Case The judicial committee at that time was still the final court of appeal from the courts of Canada It continued until 1949 And on that historic day it over turned Supreme Court of Canada ruling by declar mg that the word persons in Section 24 of the British North America Act anadas constitution includes nttnllJIIS of the male and female sex It was great victory for the Alberta group in prin ciple and in practice It meant that the federal government could no longer refuse to have women ap pointed to
