Barrie to amend bylaw 69 33 so as to make the provisions of Section 35 of the Planning Act applicable to lands within the City of Barrie WHEREAS it is provided by Section 35 of the Planning Act RSO l970 Chapter 349 as amended that where there is an Official Plan in effect in municipality the Council of the municipality and by law passed under Section 35 may as condition or development or redevelopment of the land or buildings in the municipality or in defined area or areas thereof prohibit or require the provision maintenance and use of the facilities and matters or any of them set forth in paragraphs numbered to I2 of Section 35 and may regulate the maintenance and use of such facilities and matters AND WHEREAS there is an Official Plan in effect for the City of Barrie NOW THEREFORE the Council of The Corporation of the City of Barrie enacts as follows Bylaw number 6933 being bylaw to regulate the use of lands and the erection use bulk height location and spacing of buildings and structures in the City of Barrie is amended by adding thereto the following section 55 DEVELOPMENT CONTROL 55l No development or redevelopment of land or buildings shall take place in the City of Barrie except where as con ditian of development or redevelopment of any land or buildings the Council of The Corporation of the City of Barrie prohibits or requires the provision maintenance and use of the following facilities and matters namely Widenings of highways that abut on the land that is being developed or redeveloped Subject to The Public Transportation and Highway lm provement Act facilities to provide access to and from the land such as access ramps and curbings including the num ber location and size of such facilities and the direction of traffic thereon Offstreet vehicular parking and loading areas and access driveways including the surfacing of such areas and driveways Walkways and all other means of pedestrian access Removal of snow from access ramps driveways parking areas and walkways Grading or change in elevation or contour of the land and the disposal of storm surface and waste water from the land and from any buildings or structures thereon Conveyance to the municipality without cost of eosemen ts required for the construction maintenance or im provement of any existing or newly required watercourses ditches land drainage works and sanitary sewerage facilities on the land Flaodlighting of the land or of any buildings or structures thereon Walls fences hedges trees shrubs or other suitable groundcover to provide adequate landscaping of the land or protection to adjoining lands Vaults central storage and collection areas and other facilities and enclosures as may be required for the storage of garbage and other waste material Plans showing the location of all buildings and structures to be erected on the land and the location of the other facilities required by the bylaw Perspective drawings and plans showing building elevations and cross sections of industrial and commercial buildings and residential buildings containing twentyfive or more dwelling units 10 Il l2 552 The Council of The Corporation of the City of Barrie is hereby authorized to regulate the maintenance and use of facilities and matters referred to in paragraph 55l 553 The facilities and matters required by paragraph 552 of this bylaw shall be provided and maintained by the owner of the land at his sole risk and expense and to the satisfac tion of The Corporation of the City of Barrie and in default thereof the provisions of Section 469 of The Municipal Act RSO I970 Chapter 284 shall apply The owner of any land within the City of Barrie referred in paragraph 55I is required as condition of develop mentor redevelopment of any land or buildings to enter in to one or more agreements with the corporation of the City of Barrie dealing with the facilities and matters referred to in paragraph 55 of this bylow No building permit shall be issued intil the plans required by clauses II and 12 of paragraph 55l have been ap proved by The Corporatian of the City of Barrie and until the agreements required by paragraph 554 have been en tered into This bylaw shall not come into force without the approval of The Ontario Municipal Board The City Clerk is hereby authorized to proceed as soon as possible with the giving of notice of the passing of this bylaw including brief explanation of Its purpose and effect and wtth the carrying out of all directions of the Ontario Municipal Board relating to the giving of such
