back five days from Aug 25 to Aug 30 but the Examiner has learned that the Supreme Court will not have time on Wednes day to handle the case It has been delayed until mutually agreeable time for both parties can be arranged friends of the Fireball FOF lawyer John Wrigley told the Examiner Friday The FOF is seeking an in junction against the eity that would stop at least temporari ly the demolition of the struc ture by the city If the FOF were successful iii its mission it would then pro ceed to take the city to court for an alleged breach of contract with the organization Wrigley has No idea as to when new date for the Supreme ourt hearing might be set Both sides will have to get together and notify the Supreme ourt as to an accepr table time and then it will be tip to the court to set an exact date Wrigley said He said the FUF is still awaiting statement file to be issued by the city Wrigley said that cross examination of the statement file the citys statement on the alleged breach of contract would be necessary before the Supreme ourt decision could be made The city however has agreed to further extension of the present firehall status until the Ontario Supreme ourt can handle the case Demolilon of the building was to have begun the week of July 17 The F01 is attempting to sue the city claiming that there is contract to keep the building landing The city had made final decision June 12 to tear the building down but temporary injunction imposed by the Supreme ourl halted the move The first five day delay in the August Supreme Court hearing had been requested by the eir tys
