live up to their warranty wont be builders anymore Michael Gage told the Barrie and District lteal Estate Board Mr Gage is technical director of the Hous ing and Urban Development Association of Tanada lltlllAC New Home Warranty Group lllllA has been in existance since the 1940s he said but the new home warranty group was only established last May After discussions with the ministry of con sumer and corporate affairs part of provin cial legislation now insists on fiveyear wars ranty on all new homes Mr Gage said HUDAC is responsible for policing and registering all Ontario builders and vendors All builders registered with lllll must pay fees and abide by the associations rules The association he said insures all homes and assures the consumer that if anything goes wrong with the structure of their new because of flat market or poor economic conditions decides to rent them he must notify HUDAC The home must be kept for sale and the te nant is made aware of this If the home is sold the tenants move out and the house is inspected again The builder must bring the property up to proper condi tions and home buyer also receives five year warranty Real estate people attending the spectors at the munici al level There already is uilding code that sets standards for construction he said and the city should be in charge of building in its jurisdiction home it Will be repaired Only builders registered with lllllA can build in Ontario he said and if the builder does not comply with HUDAC rules be will lose his regist rat ion The only exemptions to the rules are seasonal and mobile homes and homes built by the person who will live in them In other words Mr Gage explained if handyman buys some property and builds himself house he doesnt have to register BOTH SIGN Real estate agents selling new home in 1977 will have to fill out form when deposit is received and the consumer and butlder will both sign it if the builder does not complete the home the consumers deposit will be returned The law also ap lies to condominiums Mr Gage said even the structure was built in 1976 but was not completely rented The law does not agply to apartment buildings or in dustrial an commercial property If builder constructs 20 homes and then
