cher and former mayor Willard Kinzie over site pact Barrie gas station owner is suing the city for compliance with site plan agreement for proposed selfservice gas bar at Broadmoor and Little avenues in Allandale writ was issued at county court Tuesday demanding either compliance with the six page agreement dated Aug 10 or damages arising from fail ure to comply Donald Alexander owner of gas station on Anne Street and car wash and gas station on Bayfield Street launched the suit rather than pay $2000 for sewer connections not called for in the site plan agreement The agreement calls for pay ment of $321719 for the owners share of the cost of con struction of sewer and road on Broadmoor Avenue along with other payments and land dedication which Mr Alex ander says bring the total cost of the agreements provisions to$ll000 building permit pursuant to the agreement was issued Oct But letter from deputy city clerk Peter Westwood dated Oct 18 describes the sewer and road clause as in error it should read watermain and road theletter says further letter from Neil Fox public works superintendent sets the sewer cost at about $2000 payable in advance The cost arises chiefly from the fact that the Broadmoor sewer main stops 115 feet or about $1500 worth short of Mr Alexanders property and he would have to pay for the exten sion CITY MISSED IT City administrator Gerry Tamblyn said today the fact that no sewer fronts on Mr Alexanders property was missed when the agreement was drawn up He said the city cannot be expected to pay the cost of sewer extension in order to facilitate develop ment Mr Westwood said today the $321719 was not payment for city services but Was to reimlt burse the developer who originally installed the Broad moor Avenue water main as required under the City of Bar rieAct He said it is incumbent on developer in this case Mr Alexander to bring services to his property if they fall short May be near agreement in mortgage issue Viola MacBride and the Ur ban Expansion Group may be close to agreement Carl MacBride Mrs Mac Brides son told The Barrie Ex aminer this morning he advised his mothers lawyer to offer the developer deal Mr MacBride said his mother is willing to discharge the mortgage providing the developer allows her to go after fair market value for the property Were not trying to hold up the developer he said But we still want the right to come to court He said if the developer agrees his mother will vacate 258 DunlopSt and accept the rest of the mortgage money from Urban Expansion want to get this straightened up as soon as possible he said All were doing is discharging the mort gage Mrs MacBride has lived in the building since Monday when all the other tenants ex cept for one family moved Ur ban Expansion threatened her with supreme court writ for damages and petty trespass ing charge The developer wants the pro perty as part of the site for 118unit condominium apart ment development Mrs MacBride claimed she still owned the property be cause the developer never made final mortgage payments Mr MacBride said he did not want his mothers money tied up in legal battles for the next four or five years In July 1973 Mrs MacBride listed the property for sale at $39500 and in October The Ur ban Expansion Group offered $35000 The developers offer was ac cepted Oct 21 after it was in creased to $40000 Mrs MaiBride refused to close the deal until Urban Ex pansion increased the price to $45000 in 1974 when the title changed hands CAPSULE NE Ws Higher level for pound LONDON Router The British pound jumped more for the rescue coordination centre of the Canadian Armed Forces said CLASSLESS DISPLA Mounting tide of penaltles forces early close to game By RANDY MCDONALD Examiner Sports Editor Orillia Juveniles decided to forego the usual pleasantries of minor hockey league game Tuesday in favor of bickering disorder and penaltymarred contest against the Allan Cook Juveniles of Barrie The 120 penalty minutes called in the abbreviated contest of the York Simcoe Minor Hockey League at the Barrie Arena Tuesday was disgraceful classless display minor hockey at its worst And downright boring decent first period of hockey was snowed under by the mounting tide of penalties The continual stoppage in play led to the game being called with 28 left in the final period As sidelight Barrie won 42 Much of the blame has to be placed on the lack of player control by Orillia coach Ron Pifer As his poise went so did discipline He yanked his squad or at least most of it off the ice bet ween the second and third periods despite the referees re quest to cancel the break due to the time factor imposed on the minor hockey game Orillia took 73 minutes in penalties At the end of the game Gerry Wingrove of Orillia and Barries Mike Doyle traded punches which led to game misronduets No doubt further repurcussions will follow As the game dragged on it became more and more ap parent that neither club wanted to play hockey to any great degree Cook Juveniles were no an gels either Fortyseven minutes in penalties is nothing even if this is not mentioned in the site plan agreement Mr Westwood said the error in wording arises from an assumption by city solicitor Rowe who drew up the agreement that sewer main already extended to Mr Alex anders property Mr Alexander and his lawyer Marshall Green are arguing that the site plan agreements requirements are comprehensive and that Mr Alexander has no legal obliga tion to comply with additional requirements The city doesnt know where their own bloody sewers are Mr Green says If the city makes mistake were to pay Mr Alexander originally ap plied for permit to build twoisland station on his 11600 squarefoot parcel in De cember 1975 The parcel ad joins an existing small shopp ing plaza He was told that his proposal did not conform to zoning re quirements which call for 50000 square feet for commer cial development However he was allowed to proceed under site plan agreement which gives the city detailed control over the development As result he spent some months waiting while the pro posal went twice through plann ing board city development committee and city council through one public hearing and eventually to the Ontario Municipal Board which gave approval in AugUSt Youd think he was Ca dillacFairview Mr Green says The building permit was held up further six weeks while what Mr Alexander describes as nitpicking requirements were satisfied SILLYREQlIREIEJT Mr Green says it appeais that Mr Alexander should not have been made to proceed under site plan agreement in the first place He says the 50000 square foot requirement should be understood as apply ing to the total commercial development in location in this case including the plaza though it is owned by dif ferent developer You dont look at each in dividual establishment as needing 50000 square feet he says It would be silly to say the bank in the plaza has to have 50000 square feet Mr Alexander says he would have been in business in March if he had been allowed to pro ceed without the site plan agreement He says he was urged by another developer to sue the city rather than submit to site plan control but chose to go along with what the city asked Four players left on list Two golatenders forward and defenccman are the four players left unprotected by the Barrie Flyers Senior Hockey Club Today was the first cutoff date for teams il the Senior league to announce their un protected players Final date is Jan 10 Centreman Ron Robinson fiveyear veteran with the Flyers leads the list of un protected players Goaltendcrs Billy Harper and Doug Weatherall along with defenceman Blake Ball are the others Robinson is the only player seeing active duty with the Flycrs to boast about Many of the penalties called were of the cheap nature hooking slashing and cross checking Barrie did manage to remain composed in comparison to Orillia which had only 11 players dressed for the game Piler allowed his players to remain on the ice long after the final whistle and harrass the game officials Pifer himself came over to the penalty box to plant verbal barrage on the referees He also wanted the game placed under protest This was done The antics both on and off the ice overshadowed the two goals by Barrie forward Ed lloare Paul Delaney and Dan Graves had one goal each for the Cook Juveniles Rob Grygorcenicr scored both Orillia goals
