The gov- ernment has indeed made it. .a rule that when the liquor people secure some technicality, they shall not be able to score a victory `on that ac- count, and licenses` shall not be is- sued. For this concession. the temperance people have been very grateful. In numerous cases it `has saved by-laws from the eifects of proceedings in-the courts, and in many more cases it has prevented the begixuiing of such proceedings, because when once it i-s Well under- stood that the quashing of a by-law on a technicality will not have the desired result, attacks on . by-laws are discouraged` and: gradually `cease. But when the only ground for ask- ing that licenses shall not -issue is".- that the vote polled for a by-law is `very near the requisite .three-fths, it must be evident that the govern- ment could not properly heed such a request.
