Their characters are gone already, and the only dread they have of connement is because of its temporary restraints. Under the pres- ent ameliorated prison system, too, a brief term of imprisonment has its compensations formany convicts in at least providing them with support with- out severe consequent hardship. If the penalty of death were inicted on all murderers with equal and certain justice,_it would unquestionably be a valuable deterrent from the crime ; but it isa measure so extreme that juries hesitate from giving avverdict which will involve its iniction ; and thus its usefulness to society is greatly decreas- ed, if not wholly lost. Its value con- sists in it being bodily punishment, `universally dreaded. This same `dread extends to all bodily punishment, and therein consists the effectiveness of the penalty of ogging. The fear of im- prisonment exerts a comparatively small inuence in deterring "the crime.
