When he went to the mill,` he took with him a number of tools. When he ulti- mately quit the employmsntof Kean he let the tools remain at the mill for a time, but subsequantly removed them. Kean and Win- eld had a dispute, and the former, malicious- ly swore out a warrant chargin Winfield with stealing the tools from his mil. The latter was arrested, committed for trial, and upon the case coming up for hearing before the Court, it was prevcn conclusively that no theft had been committed. Afterwards Kean again had Wiulield arrested charging him with assault, which was also dismissed. Hence the action. The cvidenceof plaintiff went to show that Kean had tried to hire him to deface the marks on Mr. Power's logs at Victoria Harbor. that he had refused and had informed Mr. Power's foreman, that an at-` temnt actually was made I) Kean to cut some of -ilr. Power's logs, wliieh attempt was frustrated by the information given by lain- ti`, and the said information being the a leged cause of the malicious prosecution. The case for the rosecution was not closed when the Court in jeurned.
