The notice was sent through Messrs. McCarthy, .Boys it Pepler. a rm Mr. Leadlay em- ploys to transact all his law business. That Mr. Robinson disclaimed his seat, no one ' wonders: in fact the wonder is that any, gentleman in his peculiar position could nd courage to aspire to municipal honors. here present, over his own signature, if ne- cessnry. Hisviwatch also, taken `mne- ' -time, was returned to him,-afterwards by Palmer. . He also said he was well - aware of Palmer's going through him, but yet was unwilling to offer any resis- ' tance, thinking he. was in a bad crowd and fancying that probably he would get the things back `all right. Flemingiduring his spree had gone the ronndspf the hotels, and appears to have spent the greater part" of $20 which he stated he got fromhis em- ployer when leaving the shanty for Barrie. According to the statement of J oseph, Mar-' . rin, another witness, the man Fleming had beenlrelieved of his property quite openly` in presence of the parties in the house and ` with the view of taking care of. it for `him. An inmate of the house,Lew Devitt, who gave herself out as a visitor `of Mrs. Howard s, swore that she saw Palmer and one Dennis Sullivan with papers on the the table, including a letter, which Palmer opened and took therefrom several bills. Subsequently he put the papers back in Fleming's pocket. This witness also stat- ed that when Palmer and Sullivan came back with the robbed man in order to have themselves cleared of theimputation of theft, the women were afraid to tell the truth about it,but said they knew, nothing as to who committed the robbery. Mrs. Howard herself gave evidence corrobora- tive in_ part of that of the. last witness. Mr. Hewson, who appeared for deft, sub- mitted that no primafacie case had been made out, and also held that even if (left. _did take the money it was done with con- sent of the pxosecutor and therefore- not felonlously. His Worship overruled the objections and committed deft. for" trial, but admitted himto bail. Mr. Cotter, Crown Attorney, watched the case for the prosecution. In` answer I have only to say that such is not the case, nor has such a course ever been contemplated, nor is it at all likely we shall do so. _ It is true that our opponents are raising all sort of frivolous objections to our petition, but each one is being suc- cessfully disposed of. For instance thev-ob- jected to my signature because I signed my usual-signature of VValter J. Ballard,` while the Voters List says " Walter Bal- lard." Every day I am more convinced that we shall eventu:1lly--a.nd not/far 011' either --carry the Act by a good ma.jority.l Our late municipal election augurs well for our success. We elected a temperance man as Mayor by a majority of 1021 over the other candidate who avowed himself the nomi- nee of the anti-Scott Act `party. The Scott Act was .a direct and almost the only issue in the election. Besides this. D.` B. Chis- holm, the President of the Scott Act Asso- ciation. was elected asvan alderman in a. ward not his` own, and polled the lar- gest vote of any alderman and all without his canvassing for a single vote. This- cry of giving up arose out of a mistake made by the Government in misconstruing a let- ter of our_ Solicitors, and returning the pe- tition which we did not take out of the ex- tpress oice but sent it back at once to Ot- [ tawa where it is still under'considera.tion. I Yours faithfully, ` ; ` WALTER J .'
