Mrs. Clark, the first witness, stated that on the nigh `of March 16 , last she and her husba and children lretired about 9.30. Her husband had jnot been well for several days, had 1 not eaten and had a cold. She rubbed him with liniment before going to ` bed. `He was very restless and would not stay in bed and finally she remon- ` strated with him. He went into an-' other room and she arose. He then, returned and told her to go back to` l bed and when she refused he struck_ her on the head with a hammer.
