brougham hall saturday oct 16 in aid of brougham ball team admission 50c joe iocs frederick j aldred 23 was found guilty of manslaughter by an assize court in toronto and later sentenced to is years in prison aldred was charged following the death of william cowan malvern storekeeper the jury deliberated for three and a half hours guided from court aldred who was wearing a blue suit with a white handkerchief in his lapel pocket received the ver dict with no display of emotion however as he was led from the dock he began to sob quietly and he had to be guided by one of his wardens from the court the charge of murder went to the jury at 1215 pm after an address lasting over two hours by mr justice mackay he said it was admitted by de fence counsel that accused broke into the store of william cowan malvern with intent to commit theft he was surprised by the entry of cowan who demanded what he was doing and how he got in here mr justice mackay said there was no direct evidence that a gun was in the hands of accused at any time before the two shots were fired reference was then made to the evidence of eleanor cowan who said her father tried to detain accused cowan his lordship said was doing what he had a perfect right to do namely arrest without warrant anybody committing an indictable offence the jury was told only two ver dicts were open there were guilty of murder and not guilty of mur der guilty of manslaughter the verdict of not guilty his lordship said is not open on the evidence his lordship referred to the evidence that accused after saying ill stand jumped and then the struggle began the jury was then asked to consider the statement of accused i finally took the gun away from him and kicked it to the counter he came after me with the revolver and i told him to let me go before somebody gets hurt that said his lordship may very well be an important piece of evidence if you accept it counsel for defence says the revolver went off by accident while in the hands of cowan there is only one revolver in the case theft the court continued is an indictable offence it may well be that accused was endeavoring to resist lawful apprehension his lordship repeated no one saw the gun in the hands of accused and if you draw any inference from the course of the bullets in cowans body i charge you that that evidence being circumstantial it must not only be consistent with accuseds guilt but inconsistent with any other conclusion the jury was also asked to con sider the significance of the evid ence that mrs cowan was struck on the head with a hard object causing a wound that required two stitches or clips ghastly life story passing sentence justice mackay said your counsel has spoken in eloquent and earnest words on your behalf i shall consider what he has said as i have consider such representations but to maintain proper and judicial respect i ask those who carry out the administra tion of justice not to look only through the eyes of the defense i want to show them the ceme tery near malvern around the newly opened and closed grave i want to show a crushed and broken widow and five weeping daughters i shall ask them to maintain the proper perspective it is clear you have had few opportunities but others with a few opportunities have become a credit to society you are a youth possessed with criminal impulses you have embarked on a life of crime by this ghastly story of your life it has been revealed that in the past you have betrayed the leniency of the bench i must and can only conclude that you are an enemy of society a picture of an unhappy uncon trolled environment in a poverty- stricken home and of the character of a father who placed his home secondary in his life was painted by harry hose defense counsel he said the youth had been in trouble since his formative years violated law at 10 court records show that he has been a violator of the law since he was 16 said mr rose of nine children his south pickering
