question today following the budget address of provincial treasurer leslie m frost in the ontario legislature last week is wil there be an elec tion in ontario this year some significance is attached is very little doubt the fees imposed are prohibitive of the tourist camp business in the town ship said his lordship what was given was a power to pass bylaws for the licensing regulating and governing of tourist camps it was not a right to- prohibit tourist camps but to regulate and govern them under a guise of a licensing by law the municipality cannot in my opinion impose fees which in effect are confiscatory and prohibitive the municipality was not attempt ing to regulate and govern the camps he said the application for the order was made by james and sarah mc- cormick the applicants received costs of the action against the muni cipality and an order was given the township to pay the mccor- micks their 100 deposit the bylaw passed last year reg ulates cabins and trailers section five says fees payable for a license regulated by the bylaw shall be as follows 20 for each cabin or trailer during the period may 1 to oct 31 in any year and 30 for each cabin or trailer during the period nov 1 to april 30 it was this section which mr justice wells ordered quashed j mr justice well noticed that the j licensing fee in many cases would j absorb more than a very substantial part of the gross revenue of the tourist cabins in any tourist camp made he said affidavit evidence produced judgjby township officials suggesting the real purpose of the bylaw was to drive out tourist camps could not be used without hearing of oral evidence i think this case must be dealt with on its own particular facts he said in making his conclusions mr justice wells remarked the ques tion now arises whether the bylaw must be quashed in all or in part in this case mr justice wells continued the objectionable clauses of the bylaw are really only those relating to the amount
