stated that the dirt on the floor was 26 inches deep in one stall there was a calf and a cow and beside them was a dead calf it was submerged under the manure to the extent that only its back was showing through the refuse stated the inspector not enough feed i made inquiries as to the own er of the farm later i met the ac cused coming in with a team of horses hitched to a hav rack he had about 14 inches of straw on the wagon he told me that it was enough to last the cattle two or three days 1 dont think there was enough there for one feeding stated inspector johnston i asked him if he could not put the cattle out to pasture he stated that he could but they were up to their hocks in dirt getting out of the barn one cow couldnt get up at all she was in very poor shape later i learned that the cow had died and the accused had to get a horse to pull the carcass out of the barn all the cattle had the appear ance of not having had sufficient food all winter they were thin and appeared to have no strength at all seventyfive per cent of the animals had no hair left on them so far as their legs and stomachs were concerned the water bowls had manure in them we went up stairs to the loft where feed is usually kept and there wasnt a scrap of straw of any kind testi fied inspector johnston the officer stated that while accused told him that the calf in the stall had been dead for two or three days he expresed the opinion to the court that it had been dead for a much longer period provincial constable j cmaguire who accompanied inspector john ston and dr black to the barn where the animals were housed corroborated the evidence of the two previous witnesses i have visited the farm since this charge was laid and since then an attempt has been made to clean up the place stated the officer mac forsythe a neighbor of the accused stated that he had known pugh all his life asked about the condition cf the cattle by j c anderson kc de fense counsel forsythe stated the cattle are thin but then a lot of cattle are thin today both he and two other witnesses called by the defense alex snyder and george hill stated that they had known the accused for many years as a well known
