mr editor- i desire to correct some of the misstatements- of fact in your re port in the issue of may 24th of the action of russell storry against frank- c rowbotham henry cur- ran and c lambert in the first place we would point out that in the settlement finally made russell storry not only had to pay all his own costs of the action but costs of the defendants to the extent of 70000 after the 80000 arrears of interest on this mortgage were re capitalized on dec 1st 1941 the plaintiff storry still failed to pay his interest payments as they fell due and on june 1st 1914 there were still arrears of 17500 after crediting payments made by storry to the amount of 30000 up to that date this amount was subsequent ly reduced to 10500 by payments made after june 1st 1944 so that at the time the defendantrowbotham assigned the mortgage to the de fendant curran there were 10500 of arrears of interest still due there on as of june 1st 1944- and he had a perfect right to assign the mort gage without giving any notice whatsoever to the plaintiff storry by reason of the said mortgage be ing in default for more than three months the defendant curran had a legal right to sell the farm to the defendant lambert without giving any notice to the plaintiff storry the only question that was to be litigated was whether the defen dant curran did use the ordinary means to obtain for the farm a reasonable price it is quite untrue that the defendants and particu larly the defendant rowbotham had any knowledge that the plain tiff had sold 10 acres of gravel- from the farm for 500000 as alleged and it is equally untrue that the defen dant rowbotham had agreed to wait until dec 1st 1944 the date of maturity of the said mortgage for his interest as for the charge that the defen dants conspired to deprive storry of his farm it is quite fantastic as the defendant rowbotham had never met the defendant curran prior to the time he received a cheque from currans solicitor for the amount due on his mortgage and it was only after he recived the cheque that he met the defendant curran for a few moments and did not meet the defendant lambertfor many months so that the charge of conspiracy was just the imagina tion of the plaintiff the defendant lambert was purchasing this farm for an agri cultural holding for his son now overseas as the son had expressed a desire to commence farm opera tions on his release from the army and did not consider at all the grave situation alleged to exist on the said farm but when the defen dant lambert learhedofthetrue condition of the farm the state of repair of the buildings the state of cultivation of the lands the ineffic ient water supply thereon and the inaccessibility of the farm to a highway in theprdinary winter months n he was very willing to recohvey the farm to the plaintiff as he figured he could buy a much more suitable farm for his son for the same money he had offered storry to retain the said premises we trust you will give these choice in the matter in return we are given vague promises of all sorts made by a group of men who do not be lievein our form of life or govern ment men without practical experi ence of business life a few sincere men have already been deceived and are supporting this movement the great mass of voters of this province are -notde- ceived they do hot wish to travel the path of germany and italy have last tuesday mrs nelson smith accompanied them as far as mount albert- fern dorothy and lome hoover had dinner with mr and mrs j painter of ringwood on sunday mr and mrs t diller of mon golia were recent visitors with mr and mrs meed mr nelson smith and frank also robt woodcock frank harper and les hood motored to hawk lake over the weekend to try their luck for trout as they have not yet re
