the roads and weather are favorable everyone in the community are invited to attend this meeting rev chas mcgrath of stouffville is the leader of this class road superintendent under fire the general meeting of road foremen and tho municipal coun cillors ot imarkham township held to hear complaints alleged to be in tho air against tho work of the road superintendent more or less petored out without any real com plaints being offered thoro was a good attendance of road men and other farmers and when reevo padget called for de finite charges against the superin tendent none were made one or two of the road foremen who wore reported to have been circulating charges were asked pointedly about tho matter but they said they had no complaints to offer criticism however and dis cussion took plnco on tho policies and manner of tho road work dono or to bo dono but it was difference of opinion and did not involve the superintendent whoso duty it is to carrry out tlito instructions of tho municipal council it is rumored that ono ot two men on tho council are strongly oppos ed to tho superintendent and one ratepayer said nfter the meeting an effort was being mado to get iilm from within tho council just come to a council meeting and listen to tho offensive manner in which tho reevo jumps at tho road superin tendent howover deprcevo clark characterized tho wholo affair as a bit ot splto work in any caso tho superintendent is not yet engaged for 1934 but tho matter will ba faced by the council at tho next regular meeting f l button nearly three mouths before her death tho defendants wero morely c barker named as executor of the estate who is also a beneficiary under the terms of tho will along with tho other defendants and bene ficiaries under the will stanley boynton herman mcmullen mary johnson doris johnson- nellie johnson mary e mcmullen wesley boynton and mrs harmon hoover all of stouffville and locality the action was dismissed witnesses subpoenaed for the plaintiffs included mr and mrs eli shank ralph rae dr mckay mrs samuel goudie mrs mary mcmullen mrs ida allan mrs len tait rev thos laidlaw defence witnesses f l button kc miss luella holden frank and was left by the aged lady to be divided among the nine relatives mentioned as defendants in the case the case opened on monday morn ing and finished tuesday noon no defence witnesses were called al thought mr button was put in th box by tho plaintiff his honor said it was perfectly plain there was not a vestige of evidence as to fraud or misrepresentation on making the dismissal as to tho testamentary capacity there is no proof of that the testatrix had peculiarities but there is no evidence that she was not of sound testamentary capacity and there is no foundation at all for any of the other charges made this action should never have been brought concluded his lordship eli shank husband of mrs burma shank said mrs casely didnt seem to know him when he visited her in the spring of 1932 and he did not think she was capable of hand ling her affairs during the closing years of her life earlier witnesses testified as to tho condition of her house as not what it ought to be but mrs goudie under cross examination as a witness for tho complainant said she was a good housekeeper and shrewd enough to count her change when sho had frequently made purchases for her at the store recognizing any shortage due to increased cost of goods over what she thought they could be bought for liability for costs were placed against tho plaintiffs as another year rolls around i am renewing my subscription to tho tribune which is looked for hero in our homo every imonday ovening although we havo had a very long winter no doubt it is only half over cold weather set in here the middle of october with plenty ot snow and very cold howover since new years the frost has not been so severe crops in our district were fair last fall considering the dry weath er wo had to contend with later so much rain fell in tho fall that it spoiled tho stacks and feed is now becoming quite scarce a surprising- large number of farmers from south of here are sett ling in our district having been driven out by drought and grass hoppers al farmers they are too but they hadnt had a crop since 1929 i visited ono of these fine chaps the other evening he show ed me a photo of his father and lo there was which is township wins case tho township of stvincont won a damage action brought against it by gordon head of moaford according to judgment by his honor judge g w morloy in a case which was tried before him at the last division court in moaford this court caso arose out ot an automobile accident on the seventh line of stvincont on october 15 last when a truck owned and driven by gordon head went into the ditcli after it had struck a pile of loose gravel placed on tho road by the township in order to repair some holes tho truck was damaged to the extent ot 100 when it went into tho ditch and struck n pile of stones in tho judgment judge morloy found that tho road in question was kept in a condition reasonably suf ficient for tho needs of traffic over it and further finds that tho accident was caused by tho plaintiff driving at an oxcessivo rate ot speed having regard to tho weather conditions at tho timo tho narrowness ot this country road and tho fact that he could havo seontho gravel it hejiad maintained a proper lookout tho judgo further hold that the pile of stones which tho plaintiffs truck ul timately struck on tho roadside was not tho real cause of tho accident and that this pile was not a nuisance which would render tho township liable tho judgo further upheld tho dofonco contention that proper notice following tho accident had not been given by head to tho
