sheep king has won his claim for 14 agaiust the township of whitchurch for guarding his sheep while in pasture in tho township of whit church from sept 12 to tho ista the case was heard in division court at aurora on friday before his honor judge lee and judgment given for 14 and costs mr brodie was represented by mr iross kennedy of toronto and the township by mr harry naughton the plaintiff gave evidence to the effect that he had been hired sept 11 by j a clark sheep valuer to act as guard after some hesitation he consented he put on a mau in his own place on tho farm deputy reeve rae was present when he was asked by clark to act nothing was arranged about the amount of pay jhe watched the flock from sept 12 to is 1932 seven days and a month later billed township tor 7 days at 2 per day mr clark corroborated the story of brodie about engaging him and j said he received his authority to put on a watch from the reeve the council considered it the right thing to do under examition he said he considered 2 per day a fair wage although he hired men at 1 day he agreed no arrangement was made about the pay when he engaged brodie deputy reeve rae corrobor ated the evidence of brodie in so far as his engagement went with clark he was present at the interview and no wage was stated brodie was en gaged because we didnt know of no capable man to hire he never heard of any arrangement at that time whereby brodie was to pay half brodie did say he was willing to co operate on the other hand when reeve kidd came to testify he said that two months prior to clark engaging brodie he had a conversation with the sheep man and they mutually agreed to each pay half tho cost of a watch one was not engaged however from that time in july to sept 11 when the owner went on himself as stated the reeve said he had no idea brodie was engaged until some time after he was watching in 1933 brodie said he would do what was right when asked before council if he would share the cost of 1933 watch councillor morton was also called and said that this year when mr brodie ivisited the council he stated ho would do what was right in the matter the judge dismissed the offset that brodie pay half the 1933 cost for watching sheep saying that he failed to find a contract whereby brodie was liable not suggesting that anything was amiss inlmr brodies caso his honor enquired if it was the custom of these townships to submit to the sheep and dog act requiring them to pay for losses probably duo to negligence or killing by other causes than dogs mr naughton said tho department
