One of the complainants' witnesses, Moreland Lynn, described Ogilvie, Mudry reminded the jury, as '"'a reptile, a Marxist, a Com- munist, an anarchist," so- meone who tries to over- throw the government. Ogilvie's response was to call the former mayor of Midland, Mare Lynn, Mudry said. Mudry said his client is careful, thorough, and of good memory. He is obsessed with politics. "It is consistent with honesty to be critical," Mudry told the jury. He suggested to the jury that the lawyers' lawsuit was more an at- tempt to stop Ogilvie from asking questions and "keep a profitable situation go- ing" and less about malice by Ogilvie. In his charge to the jury, Mr. Justice John James Fitzpatrick's comment about the Pontius Pilate reference was that the local lawyers, alleged by Ogilvie to have betrayed their client Tiny Township, were "'likened to one of the most notorious failures to act in the history of mankind." The jury decided on the evidence given it through a period of more than four weeks that Ogilvie was guilty of libel and that the Midland Free Press was guilty of publishing his libellous words.
