Marchand supports construction delay A Lafontaine resident has given his approval to the Simcoe County Board of Education (SCBE) suspending the construc- tion of industrial arts and shop program facilities at Ecole Secondaire Le Caron until an appeal by the board is heard by the courts. The SCBE and the Ministry of Education have launched an appeal against a decision in favour of Jac- ques Marchand who brought a lawsuit against the board and the Province for the equal rights of the French language students at Le Caron. After launching an ap- peal against the judgement handed down by Mr. Justice Sirois in Toronto on July 23, the SCBE applied to have the enforcement of the mandatory orders laid down in the decision delayed. In the 45-page decision handed down, after the three week court battle in May, Mr. Justice Sirois order the board to provide the facilities and funding necessary to achieve equivalent services at Le Caron as at other high schools in its jurisdiction. As well, the court called for the board and the Pro- vince to provide adequate funding to ensure the French language secon- dary school instruction and education facilities provided in the Town of Penetang were equivalent to the English language facilities in Simcoe. In August, the SCBE in- structed their lawyers to file an appeal against the decisior that was released a month earlier. According to a press release issued by the board, while recognizing the rights given to the French- speaking citizens of Sim- coe County, the board did not accept certain findings of the judgement. It is the view of the board members that clarification is re- quired of its obligations as a school board under Sec- tion 23 of the Canadian Charter of Rights and Legal service delivery The board of directors of Simcoe Legal Services Clinic will be in Midland Oct. 22 to discuss the delivery of legal services in Midland. Marchand agreed to the delay in the construction of the addition at Le Caron providing the board met a number of stipulations. The Lafontaine man re- quested the appeal be dealt with as quickly as possible, the board continue developing all relevant planning for the construc- tion of all facilities that are required in Justice Sirois' "decision and the board agree to complete its in- itiatives undertaken to in- crease the course offerings at Le Caron and improve the facilities available to the students at the French high school. In an interview last week, Marchand's lawyer, Paul Rouleau, said his client agreed to the delay in order to ensure that the construction will not be suspended if the court does not overturn the current A squirrel's delight Susan Reynolds holds a dish of acorns oaks. "We are better to agree to some middle of the road idea," said Rouleau. Rouleau added if Mar- chand had not agreed to the compromise, once the appeal was complete we could be faced with an even longer delay with none of the ground work completed. "This way we are only stopping short of the actual construction," said the lawyer.
