That Sections 5.2 Residential Phase 2 (b) Policies clause (1) and Section 5.8 Special Policy Area (b) Policies (1) are hereby amended by adding a new paragraph as follows: 'For the purposes of this section the term 'development' shall not include the replacement Or upgrading of an existing substandard dwelling (0a Maximum floor area Of 83.5 square metres nor shall it prohibit the addition of a garage, carport, sundeck, or other similar non-inhabitable structure, providing that: (a) such upgrading, replacement or addition receives approval from the Council of the Village of Port McNicoll, the Ministry of the Environment and the Simcoe County District Health Unit, and that (b) the existing private sewage disposal system: is satisfactory to service the existing or replacement dwelling and any upgrading or ad- ditions proposed. Where a system is found to be deficient then a certificate of approval by the Simcoe County District Health Unit and / or the Ministry of the Environment for a new system niust be issued prior to an approval by the building department for the upgrading or replacement of a dwelling or addition thereto, and that (c) generally the upgrading or replacement of an existing dwelling or addition does not encroach upon land which would be required for a future septic system in the event of a failure to the existing system, and that (d) the upgrading or replacement of an existing dwelling or addition is for the residents' personal use and is not intended to increase the number of persons residing in the dwelling, and that (e) the dwelling is serviced with an adequate and potable supply of water. No building permit shall be issued until such time as Council is satisfied that the private sewerage system and water supply for the dwelling is adequate and that approval has been received from the Simcoe County District Health Unit and. or the Ministry of the Environment.'
