Where a system is found to be deficient then a certificate of approval by the Simcoe County District Health Unit and, or the Ministry of the Environment for a new system must be issued prior to an approval by the building department for the upgrading or replacement of a dwelling or addition thereto, and that (c) generally the upgrading or replacement of an existing dwelling or addition does not encroach upon land which would be required for a future septic system in the event of a failure to the existing system, and that (d) the upgrading or replacement of an existing dwelling or addition is for the residents' personal use and is not intended to increase the number of persons residing in the dwelling, and that (e) the dwelling is serviced with an adequate and potable supply of water.
