A new bill introduced before the Ontario legislature on April 15 has presented a new wrinkle in the annexation dispute between the town of Midland and the Township of Tiny. Bill 62, which received first reading on April 15, is an amendment to section 24 of the Municipal Boundary Negotiations Act. The amendment provides for the withdrawal of an application to the Ontario Municipal Board '"'at any time before the Board has finally determined the matter." Midland applied to the Ontario Municipal board for annexation of 2,600 acres of Tiny Township on April 6, 1981 , and subsequently on Feb. 8, 1982 for an- nexation through the new Municipal Boun- dary Negotiations Act. Tiny was successful in forcing Midland to with- draw second bylaw in April, before the case was heard before the Supreme Court of Ontario. - Tiny has argued that the original application to the OMB should be heard, while Midland's position has been to re- apply under the modified Negotiations Act. Bill 62 also stipulates that the withdrawal of an application to the OMB will mean that "any notices of ob- jection. . that may have been filed. ..are deemed to be also withdrawn." In the face of this setback, Tiny Township has "'instructed _ their Toronto solicitors to appear before a legislative committee to present their case in hopes of intervening," according to Tiny ad- ministrator Guy Maurice. Under Bill 62, the OMB may award costs concerning applications that are withdrawn before they are heard Although Midland officials have main- tained that the town had not spent money on annexation studies and preparation, Tiny ad- ministrator Guy Maurice confirmed that the township has spent "considerable"? money On consultants and studies since midland's initial annexation bid in 1981. The new amendment to the Boundary Negotiation Act, in allowing the withdrawal of applications before the OMB, removes obstacles preventing re- application by Midland for settlement of the dispute' through negotiation. The negotiation process involves politicians from both sides under a provincial mediator. Although public information meetings are possible under the format, the negotiations are not open to the public.
