THIS NOTICE is directed to all Property owners in the Town of Penetanguishene and to all property owners in the Townships of Tiny and Tay, whose land is adjacent to the corporate limits of Penetanguishene. TAKE NOTICE that the Council of the Corporation of the Town of Penetanguishene intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 35 of The Planning Act for approval of By-law No. 1978-29 passed on the 24th day of April, 1978. Section 2.92 is hereby deleted in its entirety and replaced by the following: "2.92 (a) STREET means a public highway or public road which affords a principal means of access to abutting lots and does not include a lane or a private right-of-way. (b) IMPROVED PUBLIC STREET shall mean: (i) a street assumed by a bylaw of the Corporation as a public highway; or For several years now Penetanguishene Council has been discouraging development on lanes in town because of the problems in maintaining them. Presently however this policy is not stated explicitly in the municipality's zoning by-law. Con- sequently the purpose of By-law No. 1978-29 is to clarify the town's position on this matter, to make it quite clear that no new buildings can be built on lanes at the moment. THE ONTARIO MUNICIPAL BOARD may approve of the said by-law but before 'doing so it may appoint a time and place when any objection to the by- law will be considered. Gagne, Clerk The effect of By-law No. 1978-29 is to amend two (2) sections of the zoning by- law, one 'general provision' and one "'definition"; and so this is more of a housekeeping matter than anything else. Furthermore it should be noted that these changes will not affect the zoning of anyone's property.
