Midland youth receives five months A Midland youth was sentenced to a total of five months in jail in Provincial court on Monday morning Howard Berriault was given three months for break and enter, one month for wilful damage and breach of recognizance, and one month for resisting and obstructing an officer Beriault pleaded guilty to the charges several weeks ago. However, sentencing was put off until a pre-sentence report could be prepared by a probation officer Mr. E. Symons, a Midland lawyer presented the report. He told the court that 16 year-old Berriault had an unstable family life and that he was on his own and supporting himself He said that Berriault did not "appreciate the gravity of the situations he found himself in."' Symons told the court that a jail term probably would not help Berriault rehabilitate himself. He added that Berriault had a drinking problem and alcohol had been involved with his numerous run-ins with the law Fred Horton, acting for the Crown said that he believed the break and enter was done with malice and forethought He said he saw 'no symptoms of maturity" in B erriault. He added that he felt Berriault was not capable of looking after himself Judge Nadeau said Berriault had '"'a rather serious criminal record" He was satisfied that the court "must impose a term of imprisonment."' He added that in handing down the prison terms he had taken the fact that Berriault had had an unfortunate background into account Probation Susan Perault and Maurice Desrochers were both put on probation for causing a disturbance in August of this year on the Midland town dock. Both Perrault and Desrochers pleaded guilty to the charge. The police report said that an officer spotted a group of youths on the dock at about 3:30 a.m. on August 30 and told them they should go home. At 5:20 a.m. on the same day, the officer received a complaint about people yelling from someone sleeping in a boat which w as moored to the dock. The officer apprehended three people, the two accused anda juvenile. John Gignac acting as Duty Counsel spoke for the two accused. He told the court that they were both 16 and both unem- ployed and out of school. Gignac said, "'in view of the young ages and in view of the fact that they don't have records, I am asking your honour for a conditional discharge.'"' Horton said he had no objection to Gignac's suggestion. Nadeau in handing down sentence said, "'it isn't the worse offense in the criminal code."' He added that his main concern was that two 16- year-olds were out so late. He said it was obvious to him that there was no supervision at home. Friday, December 2, 1977, Page 11
