Excess alcohol conviction leads to 40 days in jail A 30-year-old Port Severn man was _ sen- tenced to 40 days in jail after he was convicted in provincial court in Penetanguishene last Thursday of excess alcohol. It was his second conviction. Alcide Boucher pleaded guilty to the charge, laid on April 30 of this year in Tay Township The court was told an Ontario Provincial Police constable had spotted Boucher travelling at high speed along Muskoka Road 5. After sliding part way through the intersection with Highway 69, he was seen crossing the centre line of the road several times. When the officer stopped him, he noticed Boucher's eyes were watering, he was swaying on his feet, and he smelled of alcohol. A breathalyzer test showed an alcohol level of 220. In sentencing Boucher, Judge Len Montgomery told him, "'If you have an alcohol problem, Mr Boucher, now is the time to do something about it -- not after you kill somebody." He then allowed Boucher to serve his sentence on weekends. * Theft under $200 A 21-year-old Toronto man got off with a $250 fine and 12 months probation, after he pleaded guilty in provincial court last Thursday to a charge of theft under $200. Kenneth Skidmore was charged on August 11. The crown attorney told the court Skidmore and some juveniles had been in the parking lot of the Port MeNicoll Inn at 3:14 a.m. on August 11, when Skidmore syphoned about 10 gallons of gasoline from a nearby truck into a gas can. The estimated value of the gasoline taken was about $18.00. Police later questioned Skidmore about the in- cident, and he admitted his involvement. As well as the fine of $250 or 30 days in jail, and the 12 months probation, Skidmore was ordered to make restitution in the amount of $18.00 to the owner of the truck, Crestway Electronics of London, Ontario. Excess alcohol A fine of $300, or 40 days in jail, was the penalty assessed a 38-year-old Port MeNicoll man, who pleaded guilty in provincial court last Thursday to a charge of excess alcohol. Wayne Jones was charged in Tay Township on March 19 of this year. The court was told an Ontario Provincial Police constable had seen a vehicle parked partly on the north shoulder of Highway 12 opposite the Wye Marsh. The engine was running, the lights were on, and Jones was sitting in the driver's seat. When the officer talked to him, he noticed Jones' speech was slurred and his breath smelled of alcohol. A breathalyzer test yielded a reading of -180. Excess alcohol Involvement in an accident after he had been drinking led to a conviction in provincial court last Thursday on a charge of excess alcohol for a 28-year-old Etobicoke man. Terrence Crowther was involved in an accident at 11:55 p.m. on August 19, on Highway 69 north of Duck Bay Road in Tay Township. Police in- vestigating the accident discovered he had been driving one of the vehicles involved, and noticed that there was a smell of alcohol about him. They arrested him. and took him back to the detach- ment, where a breathalyzer test revealed an alcohol level of .140. Provincial Judge Len Montgomery ordered Crowther to pay a fine of $225, or spend 40 days in jail. Drive while prohibited A quick trip into town in July led to a $150 fine in provincial court Thur- sday for a 25-year-old Clarkson man. Lawrence Ashbury pleaded guilty to a charge of driving while prohibited from doing so by reason of a legal suspension. The court was told Ash- bury had been driving at a high rate of speed along Ogden's Beach Road in Tay Township, on July 25, when he was stopped by the police. A check on his licence by the officer showed it had been suspended in 1976 for non-payment of a fine. The defence told the court Ashbury had not been in the habit of driving while his licence was suspended, but had been driving from his summer residence into town to pick up medication for his wife, who was sick. Ashbury maintained that his wife normally drove the car. The judge ordered him to pay a fine of $150, or spend 15 days in jail.
