Anthony Tobey was charged as a result of an incident on September 14 of last year, in which he broke into Arc Industries in Midland, and stole $19.00-in cash and stamps from a cash box kept in a desk drawer. The court was told Tobey broke into the building by knocking in a piece of wood which covered a window. Provincial Judge Len Montgomery told Tobey if he did not shape up his life, he would spend most of it behind bars. He said it costs about $15,000 to keep someone in jail for a year, and that was a great expense to the taxpayers. But, he said, if Tobey wanted to spend his life in jail, the courts would accommodate him. Montgomery ordered that Tobey be put on probation for 24 months after the jail sentence was served. Theft under $200 The theft of a pair of boots from Zellers last fall resulted in a con- ditional discharge and 15 months probation for a 23- year-old Midland man in provincial court Thur- sday. Herbert Boyer pleaded guilty to the charge in an earlier court appearance, but was remanded to Thursday for sentencing. The court was told Boyer had enough money in his pocket to pay for the merchandise at the time of the theft, and he had a Zellers charge account. Boyer could not explain why he had been moved to steal the boots. Possession of marijuana A 26-year-old Midland woman who _inad- vertantly gave herself away to police pleaded guilty in court Thursday to a charge of possession of marijuana. The court was told that Terry Reid had been stopped for a routine check as she was driving along Highway 12 at 2:10 a.m. on December 22 of last year. When she opened her purse to get her driver's license, the officer noticed a plastic bag containing "a green plant-like substance " in the purse. Reid waived her right to have the substance analyzed, and admitted it was indeed marijuana. Judge Montgomery warned her that whether or not she agreed with the law making possession of marijuana illegal, she was obliged to obey it. Pierre» Therrien pleaded guilty to the charge, which was laid on January 21. The court was told the Ontario Provincial Police made a routine check ona car on Yonge Street near Highway 27 in Midland and noticed a small plastic bag thrown out of the window as the car pulled over. The bag was retrieved by the police, who found it contained an ounce of a green plant- like substance. They questioned the four 'oc- cupants of the car, and none of them admitted ownership of the bag. Later at the police station, Therrien admitted he was the owner of the marijuana. Judge Montgomery said before _ passing sentence that he was concerned about the variety of drugs Zverina had in his_ possession, although he accepted the duty counsel's suggestion that the amounts had been small enough that it did not look like he in- tended to sell it. Hook who had not' been drinking, obliged, but the two were involved in a minor accident on the way home. There was only minor damage in the accident there were no injuries, and no charges were laid as a direct result of the accident. The charge of failing to appear was laid when he sent an agent to appear in court for him, while he was at work. Hook's attorney told the court he realized jail terms were normally imposed for the two of- fenses, but asked that, in view of the cir- cumstances, the judge _consider the offenses fining matters.
