Tenants and landlords The following is the second in a three part series article written to better inform both landlords and tenants of their rights and obliga- tions. Tenants have the right to priva- cy in their rented dwelling. Ocassionally, it may be necessary for a landlord to enter the dwelling. However, neither a landlord nor a landlord's representative has unlim- ited right of access. To exercise a _ Tight to enter a dwelling, a landlord must give the tenant 24 hours writ- ten notice specifying the time the landlord plans to enter the dwelling and must enter during daylight hours only. Similarly, if a tenant fails to keep the dwelling clean, or if a ten- ant fails to pay the landlord for any damage to the dwelling caused by the tenant or tenant's guests, or to repair the damages, the landlord can apply to District Court to solve the problem. It is the questions in the checklist which really chal- lenged the students' notions of the needs of those who have some physical limitation or disability. Answers to questions including the following had to be deter. mined: 'Do walks have a level sur- face at the top which is at least 5' x 5' (1.5m x 1.5m) if a door swings out on to the platform or toward the walk, or 3' x 5' (0.9m x 1.5m) if the door doesn't swing onto it?' The students also took inventory of services for the hearing impaired. They found that only one of the three public phones in Terrace Bay is equipped with an incoming voice amplifier, which is the rocker-type device on the receiver of the phone that allows for variable volume. It is located in McCausland Hospital. Although many students feel that services for the locally dis- abled ought to be improved, others contend the issue is not one of great concem. "T don't think that it's a major problem here," said student Donna Borutski. "There's not that many (disabled) people. If they go out, there's someone to help them," she added. She and the other three students in her group stated that store per- sonnel in both towns told them staff are aware of occasional diffi- culties. The store employees acknowledge the fact that there may be some problems with acces- sibility and ease of movement once in a store, and they are willing to help, DAG will study the reports once they receive them and will look at priorities. For most of the students, however, it was more than a report. It was not only a study of society, but of themselves. As Sue Kinney said: "It's hard to watch someone get somewhere and know they're having a hard time." The tenant should be sure to keep detailed receipts for all repairs and submit them to the landlord for repayment. Under the Landlord and Tenant Act, a tenant is not obliged to move out of a rented dwelling simply because the term of the tenancy or lease comes to an end. When a fixed-term tenancy agreement expires without the landlord and tenant entering into a new agree- ment, the tenancy is automatically renewed on a month-to-month basis under the same terms and conditions as the expired agree- ment. A landlord or tenant who wants to end a tenancy must give proper notice. The notice must also state that the tenant does not have to leave, but the landlord may apply to the Court to regain possession. A tenant has the right to dispute the application in District Court. A tenant who wants to terminate an agreement at the end of a tenan- cy is not required to provide a rea- son for the termination.
