On Dec. 6, 1966, Joseph Gar land, 83 of Cherrywood, was wakened at an early hour by three youths who had entered his home. The accused was one of the three who had entered the elderly man's home. When he attempted to put them out of his house he was "'pushed around by the youths". The owner had "more or less pushed the others out of the kitchen door which was shut on his arm by the youths. The slamming of the door on Mr. Garland's wrist broke the man's arm," Ontario Provincial Pol- ice Constable F, Armstrong tes- tified. An old age pension cheque and another cheque were stolen from Mr. Garland, One cheque was cashed by the accused signing Mr. Garland's name to the cheque. THREE-MONTH TERM A three - month jail sentences was imposed on Gerald Joseph Dwyer, 28, of Oshawa, who ap- peared on a charge of driving while his licence was under sus- pension. On a further charge of driving while his ability was impaired by alcohol, he was sentenced to three months in jail which will run concurrently. Evidence showed the accused, who is unemployed, was invol- ved in a motor accident last Sept. 29 on Highway 401. At \that time he told the investigat- jing officer he had lost his dri- jver's licence in June, 1966, as the result of previous conviction. ACCUSED JAILED Convicted on a charge of as- sault occasioning actual bodily harm, Jesse Marsden, RR 3, Port Perry, was sentenced to three months in reformatory. The accused was involved in an altercation Dec. 17 in Scu- gog Township, He had been drinking at the time of the in- cident. In passing sentence Magis- trate Jermyn said the court was giving the accused the benefit of the doubt. A recommenda- tion would be made, he said that Marsden be sent t the alcoholic treatment centre.
