A bailiff of Montreal Su- perior Court has wanted to know for about a month, The burly former president of fon of. Canada (Ind.) didn't show up at a required Mont- real criminal court appearance Monday. A bench warrant was issued for his arrest. If he has left Canada, a jus- tice department source in Ot- tawa said extradition could be sought if he is in a country with which Canada has an ex- tradition agreement. There has been speculation--but nothing more--that Banks has gone to his native United States. Neither Banks nor his white Cadillac have been seen since July 21 when a bailiff called at his home in suburban Pointe Claire in a vain attempt to hand him a warrant ot have him serve 30 days on a con- tempt charge. WAS DEPOSED Him There with intent to wound, maim and disf! re, Would his absence affect his $25,000 bail? When Paul Martineau, Pro- gressive Conservative MP for Pontiac - asked the question in the Com- the Seafarers' International Un- agg Monday, Justice Minister Temiscamingue, uy Favreau replied: "The question is under study and we will take the best course in the interests of justice." Earlier, he told Creditiste Leader Real Caouette he has no whereabouts of Banks. DIDN'T APPEAR After Banks did not appear in court Monday--a formality to get a date for the hearing of incitement charges against him and 13 other SIU members--his lawyer said he didn't know his client's whereabouts either. His bail of $1,000 was can- celled. It had been allowed on the charge of conspiracy to vio- late the Canada Shipping Act by inciting sailors to walk off their ships to attend a demon- stration in Ottawa last October. They got within 100 yards of the animal when it ran off. "It was at this time I could see it was a wildcat with a long) tail," said Mr. Moncion. He said the animal was about two and a half feet high, at least five. feet long, and of medium brown color. He said its tracks were about three inches wide and three inches long. Bob Catton, senior conserva- tion officer here, said he was rather dubious that the animal was a cougar or eastern moun- tain lion, as it is sometimes called. "Anything is possible where wildlife is concerned, but until such time as we come up with a specimen or other posi- tive proof I'm rather skeptical," he said.
