Herbert Singer, of 92 Conant street, Oshawa, died Monday June 15 after an illness of one year. He was in his 68th year. The son of the late Albert J. and Eliza Singer, he was born in Frome, Somerset, England in 1897. He married the former Ethel Hurst there in 1916. He came to Canada 51 years ago, and for the past 45 years has been an employee of the Robson Leather Company in Oshawa. He was a member of Cedar- dale United Church, and devot- John Free- ment, Mr. Cudney has been un- able to receive payment from the fund because a tractor is not defined as a motor vehicle un- der the claims act. Mr. Lerner argued that under the new act, passed July 1, 1962, there is no definition of whether a tractor is or is mot a motor vehicle. It should therefore be classified as a motor vehicle to allow payments from the unsat- isfied judgment fund. Mr. Justice Brooke agreed with W. L. Mitchell, acting for the minister of transport, that because the mew claims act makes so many references to the Highway Traffic Act, it is reasonable to consider related statutes when considering the claims act.
