AND WHEREAS the Corporation has established a County Road system under and by virtue of the authority vested in it by The Highway Improvement Act, R.S.O., 1960, Chapter 171, and the predecessors of the aforesaid statute. AND WHEREAS the Corporation is empowered by Section 64 of the aforesaid Highway Improvement Act to enact the within By-law, subject to the approval of The Ontario Municipal Board. NOW THEREFORE THE COUNCIL OF THE CORPORA- TION OF THE UNITED COUNTIES OF NORTHUMBERLAND AND DURHAM ENACTS AS FOLLOWS: ]. In this By-law (a) "Set Back Line", unless otherwise provided, means the nearest limit of the proposed building to the centre line of any County Road in the Counties' Road System estabiished by the Corporation as aforesaid; (b) '"Building" includes any structure, any addition to an existing building, and any building or part thereof replacing, in whole or in part, a building existing at the time of the pass- ing of this By-law, and there-ofter destroyed, in whole or in part, from any cause; (c). "County Roads" means all County Roads forming part of the road system of the Corporation, namely, County Roads Numbered, 1, 4, 5, 8, 9, 10, 13, 14, 16, 16A, 17, 18, 22,.23, 28, 258, 26, 27, 31, 34, 35, 36, 38, 39, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66, 70, 71, 72, 73, and 74, and Trenton Suburban No. 1, (being part of existing County Road No. 38), all as existing on the date of the passing of this By-law in the County Road System, and as established by and described in By-law No, 948, and any subsequent amending By-law, or By-laws passed in substitution thereof, excepting, however, all County Roads within the limits of all incorporated Towns and Villages in the said United Counties. 2. No person shall construct, erect or maintain any building, any part of which is located closer to the nearest limit of any County Road: (a) Than 37 féet where the road is 86 feet wide; (b) than 47 feet where the road is 66 feet wide; (c) in no case closer to the centre line of the original road allowance than 80 feet, except as herein otherwise provided. 3. (a) Where the proposed building is to be erected be- tween two adjacent existing buildings not more than 300 (three hundred) clear feet apart, the set back line shall be the line joining the front of the two adjacent buildings, but in no case need the set back line be more than 80 feet. In no case shall the set back line be less than 10 feet (ten) from the nearest limit of the County Road; (b) Where the proposed building is to be built within 150 feet (150') of only one existing building, such building shall have the set back line of the said existing building plus one- third of the clear distance between the proposed and said exist- ing building but{in no case need the set back line be more than 80 (eighty) feet.' In no case shall the set back line be less than 10 (ten) feet from the nearest limit of the County Road; (c) Where « parcel of land on which the proposed build- Ing is to be erected is owned under distinct and separate title at the date of the passing of this By-law, has not a sufficient depth to allow a minimum set back line of 80 (eighty) feet together with a clear distance of fifteen feet to the rear of the building, the set back line shall be such as to allow a clear distance of. fifteen (15) feet at the rear of such building, but in such case the set back line shall not be less than 60 feet, (sixty). (a) No person, except under a permit obtained from the County Road Superintendent, shall construct, erect or maintain any building on lands lying within a distance of 150 (one hundred ond fifty) feet from the nearest limit of a County Road; (b) The County Road Superintendent shall, if the appli- cation conforms to the requirements hereof, within 7 (seven) days of the receipt by him of the application for the permit oforesaid, issue the permit applied for. If the application for the permit does not conform to the requirements of this By-law, the County Road Superintendent shall, within the said period, notify the applicant accordingly; : (c) A permit issued by the County Road Superintendent shall be valid only for a period of six months from its date of issue, 7. Any person convicted of a breach of any provision of this By-law shall, at the discretion of the convicting Magistrate, be subjected to the penalties provided in By-law No, 1787 of the Corporation, 8. By-laws Nos. 1760 and 1767 are hereby repealed; pro- vided however that such repeal shall not affect the previous operation of the said By-laws so repealed, or affect any right, privilege, obligation or liability acquired, accrued, accruing or incurred under the said By-laws so repealed, or affect any offence committed against the said By-laws so repealed Or any penalty, forfeiture or punishment incurred or liable to be in- curred in respect thereof, of any legal proceedings or remedy in respect of such privilege, obligation, liability, penalty, offence, forfeiture or punishment, and any such legal- proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed as if the said by-laws had not been so repealed. 9.
