The province's Special Investigations Unit (SIU), which investigates civilian injuries involving police, has taken over the case involving the shooting. Although they have not officially named the subject officer involved, sources close to the case have said that Const. Paul Williams, a veteran of more than 10 years with the Durham force, has been named a subject officer. Four other Durham officers and one OPP officer have been named as wit- ness officers, and two Mnjikaning First PORT PERRY STAR Nations Reserve police officers from Rama have been asked to provide state- ments. The SIU's jurisdiction does not extend to police officers on forces deployed by First Nations reserves. Early Thursday morning (Dec. 23) a cousin of Mr. Mclvor visited him in the hospital were he is currently listed in stable condition after surgery. A reporter was stopped at the hospital room door by police officers standing guard. Mr. Mclvor's cousin, who asked not to be named, said that although the family has had little contact with the man in recent years, they intended to follow matters closely. Mr. Mclvor appeared -- through the door of his hospital room -- weak and tired, and spoke to his cousin in a whis- pered, raspy tone. "He is all alone down here without a lawyer or money or even pajamas," the cousin said. "We are not about to just leave him here." Tom Balka, a well-known Oshawa criminal lawyer, has since been retained and was present at Thursday's hospital room arraignment. "We have agreed that the matter be set over until Jan., 4, 2000, " Mr. Balka told the Star. "My client isn't going anywhere for the time being and his medical condi- tion will have to be the prime factor before we seek a bail hearing on the matter." Mr. Mclvor's cousin was upset by the nature of the charges laid. "They just don't seem to be serious enough to warrant somebody getting shot over," he said. "The family wants to get to the bot- tom of this and find out what happened, because for someone to be shot, well I guess we were expecting the charges to be more serious than this," he said. "If there was no weapon found in the car, and I'm told there was not..... well what the hell happened out there that caused all this?" the cousin asked.
