David Sims, the lawyer who repre- sented Durham police, said the force is pleased with the decision. "I'm sure the residents of Caesarea agree," he added. "This is a good news decision for law enforcement," Mr. Sims said the day after the decision came down. "The case raises important constitu- tional issues about roadside deten- tions," he said. "The decision establishes that out- law biker gangs cannot run the roads with impunity." He added he believes the case is the only of its kind to be heard in North America. Media reports last Wednesday indi- cated the decision would be appealed. The Para-Dice Riders initiated the action against the Durham force in the summer of 1992, claiming that motor- cyclists on their way to the bikers' Caesarea property had been detained by police in a manner that amounted Biker searches are ruled constitutional by judge to harassment. The bikers also con- tended the police used the roadside checks as a means of gathering intelli- gence on their club, which they claimed in court is not a criminal outfit but "a social and fraternal organization". The gatherings that brought about the police action were attended by upwards of 300 people. On three occa- sions in 1991 and 1992, they had to run a gauntlet set up by police. The police contingent included numerous uniformed officers, members of the force's tactical unit, a canine unit, and intelligence officers in plain clothes. A number of cruisers and a paddy wagon were on the scene during the checks.
