He claimed that a moral revolution was under way and that the palintiff, who was 66 years of age, should not be pre- vented from jre-marrying if he should so desire, Mr. Justice Gale pointed to the plaintiff's evidence that he had no intention of re-marrying and said the reason given for not commenc- ing the action sooner -- want of means -- was not a legitimate ex- cuse as the plaintiff had purchas- ed property several years ago. Evidence was that the couple had separated in 1927, Peters coming to Oshawa and his wife remaining in Kingston. Referring to the ele- ment of "acquiescence" in the cases cited by Mr. Hyman, His Lordship said he was of the opinion there had been acquiescence on the part of the plaintiff in all circumstances of this case. The action was dismissed without costs. The co-defendant, Oliver LaPointe, was represented by W. J. Henderson, of Kingston. Mr, Justice Gale granted decrees nisi in two' divorce actions yester- day and reserved decision in a third. e William A. Campbell, of Oshawa, received judgment nisi for divorce from his wife, Elinore Campbell, and also custody of their two children. The plaintiff was re- presented by R. D. Humphreys, K. C Mrs. Garland Corby, of Oshawa, was granted a decree nisi for di- vorce from her husband, Thomas Corby and custody of their four children. Co-defendant in the ac- tion was Bernice Wallace and costs were assessed against the de- fendant Corby. A. W. 8. Greer, K.C. acted for the plaintiff and James R. McBrien for the defend- ant, His Lordship reserved judgment in the action of Mrs. Mary McLean, of Toronto, for divorce from her husband James McLean. W.
